Title

PUBLICATION OF THE TITLE AND SUMMARY OF ORDINANCE 20-2447, GRANTING AMENDMENTS TO REVISE AND UPDATE SECTIONS OF THE ENTIRE BLAINE ZONING ORDINANCE, CITY OF BLAINE (CASE FILE NO. 20-0019)

Background

Minnesota Statute 412.191, Subd. 4, provides for publication of the title and summary of an ordinance in the case it is lengthy, if the City Council determines that publication of the title and a summary would clearly inform the public of the intent and effect of the ordinance.  As Ordinance 20-2447 is lengthy staff is recommending adoption of the proposed summary resolution.  The summary resolution requires an affirmative vote of four-fifths of the Council and the entire ordinance is available for inspection during regular office hours at City Hall and can be forwarded upon request. 

 

Recommendation

Adopt the resolution providing for a summary publication of Ordinance 20-2447. 

 

Body

                                          WHEREAS, City Code states if the City Council of the City of Blaine determines, pursuant to Minn. Stat. § 412.191, subd. 4, that publication of the title and a summary of an ordinance would clearly inform the public of the intent and effect of the ordinance, the Council may, by a four-fifths vote of its membership, direct that only the title of the ordinance and a summary be published with notice that a printed copy of the entire ordinance is available for inspection by any person during regular office hours in the office of the City Clerk. The publication of the title and summary shall be deemed to fulfill all legal publication requirements as completely as if the entire ordinance had been published; and

 

WHEREAS, the City Council of the City of Blaine has reviewed the text of the Ordinance Summary incorporated herein for Ordinance 20-2447 as follows:

 

Chapters

Updated/amended language for all Chapters including Purpose and Intent, Rules, Definitions, General Provisions, Administration, Zoning Districts-Provisions, Residential Districts, Commercial Districts, Industrial Districts, Overlay Districts, Performance Standards, and Signs; and  

 

Administration Section

Creation of an Interim Use Permit, which allows for temporary uses that may be in place for a limited amount of time, and allows the City Council to place conditions on such uses to benefit and protect the public welfare; and

 

Residential Districts

In most of the residential districts, the same changes are made throughout these districts. This mostly occurs as the items being modified are either outdated or synced with current procedures and policies, including issuance of permits for sheds; and

 

Commercial Districts

Highway 65 Overlay District requirements regarding building materials be added to all of the commercial district standards and changes to the lists of permitted uses in these districts that change most of the listed items to fall under a “general retail” or “business and professional offices” definition. Self-storage (indoor or outdoor) has been eliminated from all commercial zoning districts, and PC (Planned Commercial) district has been eliminated from the ordinance completely as there are no PC zoning districts left in the city and staff does not anticipate using this district in the future; and

 

Highway 65 Overlay District

Current property exemptions from the Highway 65 Overlay District have been removed; and

 

Industrial Districts

The PI (Planned Industrial) zoning district has been removed from the ordinance; and

 

Performance Standards

Two sections of this chapter have been completely restructured in regard to the Site Plan process and home occupation section.  Changes have also been made to parking requirements for certain uses and a new section has been added to this chapter to address donation drop off boxes; and 

 

Signs

The Anoka County Airport Signs section of the ordinance has been removed since staff has not, for a long time, issued sign permits on airport property and freestanding signage section for the RR (Regional Recreation) district has been amended; and

 

Temporary Nursery Sales

A change that removed reference to allowing new temporary nursery sales licenses. 

 

                                          WHEREAS, the City Council of the City of Blaine determined that the Ordinance Summary clearly informs the public of the intent and effect of Ordinance 20-2447.

 

                     THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine hereby directs that the title and Ordinance Summary of amendments shall be published in the official City newspaper and hereby gives notice that printed copies of the complete Ordinance are available for inspection by any person during regular office hours at the Office of the Blaine City Clerk, and that a copy of the entire text shall be posted in the official posting place in the City, and further directs that a copy of this Resolution, as enacted will be published.
