Background

Gabe’s Rinkside Bar and Grill has applied for a conditional use permit that would allow the business to have an outdoor event, called a Men’s Expo, on September 12, 2015.  The event would include private vendors, an outdoor band and a car/bike show.  The event would be held between 11:00 a.m. and 6:00 p.m.  The site is zoned PBD (Planned Business District) and all uses in this zoning district require a conditional use permit. 

 

Attached is a narrative from the venue that details all aspects of the event.  The event will be held in the parking lot of the site, and the attached site plan indicates where all vendors and bikes/cars will be located.  Alcohol will be sold inside and allowed in the parking/event area only.  The applicant has stated it will be hiring a police officer for the event. 

 

Staff’s main concern with these types of events include noise, parking and the sale and containment of alcohol.  Since the event will be held during the day on the weekend, there is little concern regarding noise, but a condition has been added that the music must end by 6:00 p.m. that day. 

 

With regard to parking, it appears that most of the parking for patrons that day will need to be accommodated on Gabe’s other parking lot, Fogarty Arena and possibly on City property by Aquatore Park and by the Senior Center.  There is enough parking to accommodate this event given that there are no other events occurring at the Senior Center or park. 

 

With regard to the sale and consumption/containment of alcohol, Gabe’s has an on-sale intoxicating liquor license that allows them to sell alcohol in the building and in the outdoor patio.  They are in the process of obtaining a State-issued caterer’s permit that would allow alcohol to be sold and consumed in the parking lot provided they have containment measures in place.  Once a copy of their caterer’s permit is received along with a certificate of liquor liability insurance listing the City as additional insured for this event they will be able to serve alcohol outdoors.

 

Recommendation

By motion, adopt the Resolution.

                     WHEREAS, an application has been filed by Gabe’s Rinkside Bar and Grill as Conditional Use Permit Case File No. 15-0033; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on August 6, 2015.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 31.33(5) of the Zoning Ordinance to allow for an outdoor event (Men’s Expo) to be held on September 12, 2015 that includes vendors, music and a car/bike show in a PBD (Planned Business District) at 9250 Lincoln Street NE, Gabe’s Rinkside Bar and Grill  based on the following conditions:

 

1.                     This CUP amendment is for a one day event on September 12, 2015 and does not replace previously issued CUP approvals for this property.

2.                     All music that is amplified or live cannot start earlier than 11:00 a.m. and must end at 6:00 p.m. on the day of the event. 

3.                     The applicant to obtain the proper permits for the event from the Community Standards Department and all portions of the event must comply with the current Fire Code. 

4.                     The applicant to work with the City of Blaine Police Department to determine security/safety requirements. 

5.                     The applicant must submit a copy of their current State of Minnesota Caterer’s Permit along with a certificate of liquor liability insurance listing the City of Blaine as additional insured and notify the Chief of Police of the event.
