VACATION OF DRAINAGE AND UTILITY EASEMENT AT LOT 17, BLOCK 11, TPC SECOND ADDITION, VACATION NO. V17-05

 

Background

Public and written notice has been provided as required by City Charter. A petition dated September 15, 2017, was submitted to the City by Susie Johnsen requesting vacation of drainage and utility easement.  The property owner wishes to install a rear yard pool and pool deck and the entire easement is not needed for drainage or utility purposes.  The applicants represent 100% of the affected property abutting this easement.  The Engineering Department has reviewed this request and concurs with the vacation.

Recommendation

By motion, approve the Resolution.

 

Body

WHEREAS, the City Council has received a petition dated the 15th day of September, 2017, requesting vacation of drainage and utility easement at Lot 17, Block 11, TPC Second Addition; and

 

WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 16th day of November 2017, at which time all persons desiring to be heard were given an opportunity to be heard.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The vacation of drainage and utility easement at Lot 17, Block 11, TPC Second Addition is hereby approved as described:

 

The North 20.00 feet of the South 30.00 feet of Lot 17, Block 11, TPC Second Addition, as platted in Anoka County, Minnesota, except the east 5.00 and the west 5.00 feet.
