VACATION OF DRAINAGE AND UTILITY EASEMENT, CRESCENT PONDS, VACATION NO. V16-02

 

Background

Public and written notice has been provided as required by City Charter. A petition dated May 31, 2016, was submitted to the City by Nagla and Habib Mahmoud of Blaine, Minnesota requesting vacation of a portion of the drainage and utility easement on Lot 7, Block 7, Crescent Ponds.  This vacation is being requested in order to allow construction of a garage addition off of the north side of the house.  The applicant is a single property owner who represents 100% of the affected property abutting this easement.  Before the lot was platted, the original easement belonged to Great River Energy.  They have released their control over the portion being considered for vacation by the City.  The Engineering Department has reviewed this request and concurs with the vacation.

By motion, approve the Resolution.

 

Body

WHEREAS, the City Council has received a petition dated the 31st day of May, 2016, requesting vacation of easements for drainage and utility purposes granted in the plat of Crescent Ponds; and

 

WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 14th day of July, 2016, at which time all persons desiring to be heard were given an opportunity to be heard.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The vacation of draining and utility easement on Lot 7, Block 7, Crescent Ponds is hereby approved as described:

 

That part of the drainage and utility easement created by Document No. 317923 and partially released by Document No. 332747 which lies within that part of Lot 7, Block 7, Crescent Ponds, Anoka County, Minnesota, described as follows:

 

Commencing at the northeast corner of said Lot 7; thence South 9 degrees 12 minutes 16 seconds East along the East line of said Lot 7 a distance of 105.49 feet; thence South 89 degrees 52 minutes 09 seconds West a distance of 59.92 feet to the Point of Beginning; thence continue South 89 degrees 52 minutes 09 seconds West a distance of 48.70 feet; thence North 0 degrees 07 minutes 51 seconds West a distance of 27.00 feet; thence North 89 degrees 52 minutes 09 seconds East a distance of 48.70 feet; thence South 0 degrees 07 minutes 51 seconds East a distance of 27.00 feet to the Point of Beginning.
