Title

PUBLICATION OF THE TITLE AND SUMMARY OF ORDINANCE 17-2385 AMENDING CHAPTER 4.-NOMINATIONS AND ELECTIONS; CHAPTER 5.-INITIATIVE AND REFERENDUM; CHAPTER 7.-TAXATION AND FINANCE; CHAPTER 10.-FRANCHISES; AND CHAPTER 11.-PUBLIC OWNERSHIP AND OPERATION OF UTILITIES OF THE BLAINE CITY CHARTER

Background

Minnesota Statute 412.191, Subd. 4, provides for publication of the title and summary of an ordinance in the case it is lengthy, if the City Council determines that publication of the title and a summary would clearly inform the public of the intent and effect of the ordinance.  As Ordinance 17-2385 is lengthy staff is recommending adoption of the proposed summary resolution.  The entire ordinance is available for inspection during regular office hours at City Hall and can be forwarded upon request.

 

Recommendation

Adopt the resolution providing for a summary publication of Ordinance 17-2385. 

 

Body

                                          WHEREAS, City Code states if the City Council of the City of Blaine determines, pursuant to Minn. Stat. § 412.191, subd. 4, that publication of the title and a summary of an ordinance would clearly inform the public of the intent and effect of the ordinance, the Council may, by a four-fifths vote of its membership, direct that only the title of the ordinance and a summary be published with notice that a printed copy of the entire ordinance is available for inspection by any person during regular office hours in the office of the City Clerk. The publication of the title and summary shall be deemed to fulfill all legal publication requirements as completely as if the entire ordinance had been published; and

 

WHEREAS, the City Council of the City of Blaine has reviewed the text of the Ordinance Summary incorporated herein for Ordinance 17-2385 relating to Chapter 4.-Nominations and Elections; Chapter 5.-Initiative and Referendum; Chapter 7.-Taxation and Finance; Chapter 10.-Franchises; and Chapter 11.-Public Ownership and Operation of Utilities of the Blaine City Charter as follows; and

                     Sec. 4.02 - Regular municipal elections.

o                     Removing requirement to physically post election notices in all 24 voting precincts

                     Sec. 4.04 - Special elections.

o                     Identify specific dates on which special elections can be held as provided by State law as second Tuesday in February, the second Tuesday in April, the second Tuesday in May, the second Tuesday in August, or the first Tuesday after the first Monday in November

                     Sec. 4.05 - Judges of election.

o                     Clarifying the minimum number of election judges per State law

                     Sec. 4.08- Canvass of elections and taking of office.

o                     Amending days primary election canvass can be conducted consistent with State law to be on either the second or third calendar day after the primary

                     Sec. 5.05 - Filing of petition and action thereon.

o                     Clarifying calculation of days required to submit additional signatures for petition correction to begin on the date the notification letter is postmarked

                     Sec. 5.06 - Action of council on petition.

o                     Clarifying dates for referendum to be placed on a ballot based on whether submitted before or after July 1st of an even year

                     Sec. 5.10 - The referendum.

o                     Clarifying dates for referendum to be placed on a ballot based on whether submitted before or after July 1st of an even year

                     Updating term “electors” to “registered voters” or “eligible voters” throughout all Chapters

 

                                          WHEREAS, the City Council of the City of Blaine determined that the Ordinance Summary clearly informs the public of the intent and effect of Ordinance 17-2385.

 

                     THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine herby directs that the title and Ordinance Summary of amendments shall be published in the official City newspaper and herby gives notice that printed copies of the complete Ordinance are available for inspection by any person during regular office hours at the Office of the Blaine City Clerk, and that a copy of the entire text shall be posted in the official posting place in the City, and further directs that a copy of this Resolution, as enacted will be published.
