VACATION OF DRAINAGE EASEMENT, BALL ROAD ADDITION, VACATION NO. V15-05
Background
Public and written notice has been provided as required by City Charter. A petition dated October 19, 2015, was submitted to the City by Martin Harstad of New Brighton, Minnesota requesting vacation of a portion of a drainage easement on Outlot A, Ball Road Addition. This vacation is being requested in order to resize and expand the existing drainage basin to accommodate the proposed development of Outlot A. The applicant is a single property owner who represents 100% of the affected property abutting this easement. The Engineering Department has reviewed this request and concurs with the vacation.

This easement vacation is being processed under the newly adopted Charter amendment to allow easements to be vacated by resolution rather than ordinance. Please note the public hearing process has not changed, just the adoption process.
Recommendation
By motion, approve the Resolution.

WHEREAS, the City Council has received a petition dated the 19th day of October, 2015, requesting vacation of easements for drainage purposes granted in the plat of Ball Road Addition; and
WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 3rd day of December, 2015, at which time all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
1. The vacation of drainage easement on Outlot A, Ball Road Addition
is hereby approved as described:
The drainage easement over, under and across Outlot A, Ball Road Addition, Anoka County, Minnesota, as dedicated on the recorded plat thereof , and described as follows:
Beginning at the southwest corner, said Outlot A; thence on an assumed bearing of North 00 degrees 47 minutes 03 seconds East, along the west line of said Outlot A, a distance of 49.31 feet; thence South 89 degrees 30 minutes 32 seconds East a distance of 312.32 feet; thence South 00 degrees 29 minutes 28 seconds West a distance of 49.31 feet to the south line of said Outlot A; thence North 89 degrees 30 minutes 32 seconds West, along said south line, a distance of 312.58 feet to the point of beginning.
