Background

The applicant and their neighbor own two adjacent parcels, 3114 (Lot 7) and 3122 (Lot 8) 123rd Court NE.  The owners of Lot 7 would like their existing driveway to meet the required 3 foot side yard setback.  The owner of Lot 8 is willing adjust the lot line approximately 7 feet at the widest point so that the owner of Lot 7 will meet the 3 foot side yard setback for the existing driveway. 

 

The homeowner of the existing driveway on Lot 7 feels that cutting the driveway back to meet the setback will not leave them enough room to enter their garage and therefore are requesting with their neighbor to adjust the lot line.

 

The driveway of Lot 7 must meet a 3 foot setback from the newly established lot line.

 

This is a simple request for a waiver of platting to adjust a common lot line and the conditions you see listed below are conditions listed for similar approvals that have been granted in the past.

 

Recommendation

By motion, approve the Resolution.

                     WHEREAS, an application has been filed by Randal and Linda Harguth as Waiver of Platting Case No. 17-0059 and;

 

                     WHEREAS, said case involves the division of a parcel into two separate lots, Anoka County, Minnesota, described as follows:

 

                     CURRENT DESCRIPTION

                     Lot 8, Block 1, VILLAS IN THE LAKES, Anoka County, Minnesota

 

                     PROPOSED DESCRIPTION (Parcel A)

                     Lot 8, Block 1, VILLAS IN THE LAKES, Anoka County, Minnesota, EXCEPT that part of said Lot 8 which lies northeasterly of the following described line:

 

Commencing at the northeast corner of said Lot 8; thence North 79 degrees 17 minutes 26 seconds West (assumed bearing) along the northerly line of said Lot 8 a distance of 19.50 feet to the point of beginning of the line to be described; thence South 58 degrees 33 minutes 15 seconds East 20.10 feet to the easterly line of said Lot 8 and said line there terminating.

 

PROPOSED DESCRIPTION (Parcel  B)

                     That Part of Lot 8, Block 1, VILLAS IN THE LAKES, Anoka County, Minnesota, which lies northeasterly of the following described line:

 

Commencing at the northeast corner of said Lot 8; thence North 79 degrees 17 minutes 26 seconds West (assumed bearing) along the northerly line of said Lot 8 a distance of 19.50 feet to the point of beginning of the line to be described; thence South 58 degrees 33 minutes 15 seconds East 20.10 feet to the easterly line of said Lot 8 and said line there terminating.

 

                     WHEREAS, the City Council of the City of Blaine has reviewed said case on January 4, 2018.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Waiver of Platting per Section 18-9(B)(2) of the Subdivision Ordinance is hereby granted to Randal and Linda Harguth, allowing to record the above described division of Lot 8, Block 1; Villas In The Lakes (3122 123rd Court) with the Anoka County Recorder’s Office, based on the following conditions:

 

1.                     The waiver of platting must be recorded with Anoka County with the parcel to be acquired from Lot 8 (Parcel B) combined as one tax parcel with Lot 7 at the Anoka County Recorder’s Office.

2.                     The driveway of Lot 7 must meet a 3 foot setback from the newly established lot line.

3.                     The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreement and releases related to the approval, recording or administration of the waiver of platting to adjust the lot line of Lot 8, Block 1; Villas in the Lakes.
