ORDINANCE AMENDING CHAPTER 6, ALCOHOLIC BEVERAGES, ARTICLE II. - INTOXICATING LIQUOR AND 3.2 PERCENT MALT LIQUOR

 

Background

On December 3, 2015, Council held first reading of an ordinance that would amend Chapter 6, Alcoholic Beverages of the City Code.  The amendment was the result of Council direction to allow brewer taprooms as well as some other minor housekeeping items. 

 

Staff is recommending two clarifications and one correction from first reading:

 

                     Clarification of off-sale containers to include 750 milliliter bottles in addition to 64-ounce growlers, consistent with State Statute. 

 

                     Specifying Sunday off-sale hours to be between the hours 8:00 a.m. and 10:00 p.m.

 

                     Typographical error to Sec. 6-53(1)(a):

 

(a) A brewer may only have one taproom license under this chapter and may not have an ownership interest in a brewery brew pub licensed under this chapter.

Food Requirements

Brewer taprooms must have an onsite restaurant similar to other on-sale license but the requirement that a significant portion of sales come from food does not apply to brewer taprooms.  A taproom must offer food service consistent with City code which includes sandwiches, pizza, hamburgers, hot dogs, chicken wings or other principal food items, as approved by the City. Food items such as popcorn, peanuts, chips, pretzels, and other snack foods will not be considered food items. Food delivery or food trucks are not allowed to meet any level of food requirement for taprooms.

 

Off-Sale and Sunday Off-Sale

Allows off-sale for taprooms only, including Sundays.  Hours of sale consistent with State Statute.  Limitations of one-mile radius and number of off-sale licenses not applicable to taprooms.

 

Sunday On-Sale

Allows Sunday on-sale for taprooms

 

2:00 a.m. permits, brewer taproom licenses

Clarifies allowing on-sale to occur between 1:00 a.m. and 2:00 a.m. with a State-issued permit as outlined in Statute and outlining requirements for brewer taproom license and brewpub license

 

Location

Brewer taproom licenses shall not be granted within 250 feet of any school or church.

 

Recommendation

Staff recommends Council hold second reading and adopt the proposed ordinance.
