VACATION OF DRAINAGE AND UTILITY EASEMENT AT UNIVERSITY AVENUE NE AS PLATTED IN MUIR’S NORTHTOWN ADDITION, VACATION NO. V17-03
Background
Public and written notice has been provided as required by City Charter. A petition dated June 22, 2017, was submitted to the City by George Serumgard representing Metro Transit requesting vacation of drainage and utility easement. This easement was a remnant from a previous vacation at University Avenue NE as platted in Muir’s Northtown Addition. This vacation is being requested because it is no longer needed as a part of the Northtown Transit Hub. The applicants represent 100% of the affected property abutting this easement. The Engineering Department has reviewed this request and concurs with the vacation.

Recommendation
By motion, approve the Resolution.
Body
WHEREAS, the City Council has received a petition dated the 22nd day of June, 2017, requesting vacation of drainage and utility easement at University Avenue NE as platted in Muir’s Northtown Addition; and
WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 7th day of September 2017, at which time all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
1. The vacation of drainage and utility easement at University Avenue NE as platted in Muir’s Northtown Addition is hereby approved as described:
Commencing at the most northerly corner of LOT 1, BLOCK 3 said MUIR’S NORTHTOWN ADDITION; thence southeasterly and southerly along the northeasterly and easterly line of said LOT 1, also being the westerly right-of-way line of said UNIVERSITY AVENUE NE, for 469.69 feet, as measured along said westerly right-of-way line, to a point of curvature; thence continuing along said westerly right-of-way line South 18 degrees, 27 minutes, 51 seconds East, assumed bearing for 15.54 feet to the actual point of beginning of the permanent easement to be described; thence North 70 degrees, 42 minutes, 28 seconds East for 62.91 feet; thence South 19 degrees, 17 minutes, 32 seconds East for 27.50 feet; thence South 70 degrees, 42 minutes, 28 seconds West for 62.79 feet of said westerly right-of-way line, thence North 18 degrees, 27 minutes, 51 seconds West along said westerly right-of-way line for 27.50 feet to the point of beginning.
