RECEIVE PETITION AND ORDER PUBLIC HEARING FOR VACATION OF UTILITY EASEMENT, LOT 7, BLOCK 7, CRESCENT PONDS, VACATION NO. V16-02

 

Background

A petition dated May 31, 2016, was submitted to the City by Nagla Mahmoud requesting vacation of utility easements on Lot 7, Block 7, Crescent Ponds.  This vacation is being requested in order to allow for construction of a garage addition.  The easement is controlled by Great River Energy for a power line adjacent to the property.  Great River Energy has agreed to release their control over a portion of the easement.  The applicants represent 100% of the affected property abutting this easement.

Public Hearing and Adopt Vacation Resolution

 

This easement vacation is being processed under the newly adopted Charter amendment to allow easements to be vacated by resolution rather than ordinance.  Please note the public hearing process has not changed, just the adoption process.

 

Recommendation

By motion, adopt the Resolution.

 

Body

WHEREAS, the City Council has received a petition dated the 31st day of May, 2016, requesting vacation of easements for utility purposes granted in the plat of Crescent Ponds; and

 

                     WHEREAS, the Engineering Department has reviewed the petition and recommends that the City Council hold a Public Hearing on the requested vacation.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The Council will consider the petitioned vacation of easements for the property owner.

 

2.                     A Public Hearing shall be held on the proposed vacation at 8:00 PM on the 14th day of July, 2016, and the City Clerk shall give mailed and published notice of such hearing and vacation as required by law.
