Background
The Public Hearing was conducted on May 2, 2013. No questions or comments were received from the public.  Vacation of drainage and utility easements is being requested for Outlot A, Chain of Lakes Addition and Lot 19, Block 1, The Lakes of Radisson Forty-Fourth Addition due to replatting of the two parcels. The property owner represents a majority of the affected property owners abutting this easement.
 
Ordinance No. 13-2265 was introduced for first reading at the May 2, 2013 Council meeting and is presented at this time for adoption.

THE CITY OF BLAINE DOES ORDAIN:  Chapter 203 is adopted as an Ordinance of the City of Blaine to read: (Added portions are underscored and deleted portions are shown in brackets with overstrike.)
 
Chapter 203  -  Vacation of Drainage and Utility Easements
 
[203].01  -   A 5.00 foot wide easement for drainage and utility purposes lying over, under and across Outlot A, CHAIN OF LAKES ADDITION, according to the recorded plat thereof, Anoka County, Minnesota, as delineated and dedicated on said plat.  The east line of said 5.00 foot wide easement is described as follows:
 
      Beginning at the southeast corner of said Outlot A; thence on an assumed bearing of North 00 degrees 57 minutes 34 seconds East, along the east line of said Outlot A, a distance of 158.00 feet, to an angle point in said east line; thence South 89 degrees 02 minutes 26 seconds East, along said east line, a distance of 11.50 feet, to an angle point in said east line; thence North 00 degrees 57 minutes 34 seconds East, a distance of 134.50 feet, to an angle point in said east line; thence North 89 degrees 02 minutes 26 seconds West, along said east line, a distance of 17.00 feet, to an angle point in said east line; thence North 00 degrees 57 minutes 34 seconds East, a distance of 231.99 feet, to the north line of said Outlot A and there terminating.
 
      Except those parts thereof lying within the northerly and southerly 10.00 feet of said Outlot A.
 
      Together with
 
      All drainage and utility easement lying over, under and across Lot 19, Block 1, The Lakes of Radisson Forty-Fourth Addition, according to the recorded plat thereof, Anoka County, Minnesota.
 
[203].02  -  Said vacation has been made after Notice of Public Hearing in conformance with Minnesota Statutes and pursuant to Chapter 12, Section 12.06, of the City Charter of the City of Blaine.
