Background
Please see the attached letter from Lisa M. Ashley from Messerli & Kramer P.A  Ms. Kramer has made an application to remove a conditional use permit from the property records of the Centerstone Suites property known as 10580 Baltimore Street NE that is no longer in use or necessary.  This is a new type of application for the City of Blaine.  Our ordinance makes a conditional use permit not used within one year of issuance null and void.  In this case, the applicant would like to go one step further and remove a conditional use permit from property records.  
 
Resolution 02-169 was issued in October 2002 for a Hampton Inn and Suites, and construction on that particular hotel never commenced.  Later, in February 2005, the City Council granted approval of Resolution 05-33 that allowed for the construction of the Comfort Inn and Suites (currently Centerstone Suites) at this address.  Obviously, that project came to fruition and is still operating today.  Resolution 05-33 will continue to govern the use of the site while Resolution 02-169 will be removed from the property records with the issuance of this termination resolution.  
 
Recommendation
By motion, adopt resolution to terminate previously issued Conditional Use Permit Resolution 02-169, Anoka County Document No. 409138.

Body
WHEREAS, a Conditional Use Permit was issued on October 3, 2002 to allow for construction of a 62-unit Hampton Inn and Suites; and
 
WHEREAS, because the 2002 Conditional Use Permit was never acted upon and the project was not built, the Conditional Use Permit approval, consistent with Zoning Section 27.04 (f), is therefore null and void;
 
WHEREAS, the property owner has requested to remove Resolution No. 02-169 from the site's property records because Resolution 05-53 currently governs the use of the site;
 
NOW, THEREFORE, BE IT RESOLVED, that the Blaine City Council terminates Conditional Use Permit Resolution No. 02-169 (recorded as Anoka County Document No. 409138) which will allow it to be removed from the property record.
 
PASSED by the City Council of the City of Blaine this 3rd day of April, 2014.
