APPROVE JOINT POWERS AGREEMENT WITH ANOKA COUNTY FOR THE JURISDICTIONAL CHANGE AND REHABILITATION OF COUNTY ROAD 87 (105TH AVENUE) FROM TRUNK HIGHWAY 65 TO COUNTY STATE AID HIGHWAY 52 (RADISSON ROAD), IMPROVEMENT PROJECT NO. 14-11
 
Background
At the March 6, 2014 Council Workshop, County Engineer Doug Fischer discussed the turnback of 105th Avenue from Anoka County to the City of Blaine.  He stated that the pavement has seen its useful life but the subgrade was fine with no evidence of distress from subgrade failure.  He stated that the road needs a mill and overlay which is estimated to cost $1.1 million.  In lieu of the County doing a mill and overlay on 105th Avenue, Mr. Fischer stated that the County would propose to pay $1.1 million toward the City's reconstruction of the roadway.  Anoka County Commissioners are anxious to turn 105th Avenue from TH 65 to Radisson Road over to the City.
 
At the September 11, 2014 Council Workshop, staff reported that Anoka County had notified the City that they were planning to construct a mill and overlay project on 105th Avenue (CR87) in 2015 prior to the turnback to the City or the City could accept the County's last offer of $1.123 million with the turnback to put towards a full reconstruction project of 105th Avenue.  The Council authorized staff to request proposals for preliminary and final design services for full reconstruction of 105th Avenue.  Authorization of a consultant contract is on this same Council agenda for consideration.
 
The attached Joint Powers Agreement (JPA) states that the County will revoke 105th Avenue from their system on May 1, 2015.  The County will provide routine winter maintenance activities such as snow and ice removal and pothole patching to an acceptable driving surface through April 30, 2015.  The JPA also states that the County will pay the City $500,000 following execution of this agreement and the remaining $623,000 after May 1, 2015.
 
Recommendation
By motion, approve the resolution.
 
Body
      WHEREAS, the County of Anoka and the City of Blaine consider it mutually desirable to remove 105th Avenue (CR 87) from the County System and turn it back to the City of Blaine; and
 
      WHEREAS, the County and the City have long exhibited concern for the deteriorating condition of 105th Avenue; and
 
      WHEREAS, the County will initially fund a certain level of rehabilitation for the existing section of 105th Avenue in exchange for removing the road from County jurisdiction; and
 
WHEREAS, the County and the City agree that it is in their best interest that the City cause any additional geometric improvements after it has assumed jurisdiction; and
 
WHEREAS, the County will pay to the City two payments totaling $1,123,000; and
 
WHEREAS, the Joint Powers Agreement outlines the details of the turnback, effective May 1, 2015.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
 
1.      The Joint Powers Agreement between the County of Anoka and the City of Blaine with regards to the jurisdictional change and rehabilitation of 105th Avenue (CR 87) from TH 65 to Radisson Road is hereby approved.
 
2.      The Mayor and City Manager are hereby authorized and directed to execute said agreement.
