Background

The public hearing was opened on May 21, 2015.  Two property owners spoke on the proposed improvements and were not in favor of Council ordering the improvements.  Council was given an email that was received that day from the developer of one of the parcels proposed to be assessed.  The email asked Council to consider continuing the public hearing to allow more time for him to meet with the other property owners.  Council continued the public hearing in order for the property owners to meet to discuss the proposed improvements and assessments. 

 

Staff met with the two property owners that spoke at the May 21, 2015 public hearing and they stated that they had met with the developer and are still not if favor of Council ordering the improvements.  One of the developers also contacted staff and confirmed that he didn’t feel the project would be able to move forward.

 

Recommendation

Close public hearing and, by motion, deny the ordering of improvements.

 

Body

WHEREAS, Resolution No. 15-062 of the Blaine City Council, adopted on the 2nd day of April, 2015 ordered a public hearing on the proposed project; and

 

WHEREAS, the required notices were published and mailed to benefiting property owners, and the public hearing was held on the 21st day of May, 2015, at which time all persons desiring to be heard were given an opportunity to be heard; and

 

WHEREAS, the public hearing was opened and continued to the 1st day of October, 2015; and

 

WHEREAS, the public hearing was closed on this 1st day of October. 

 

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Blaine as follows:

 

1.                     Such improvements as proposed in the Feasibility Report, which was accepted by Resolution No. 15-062 adopted on the 2nd day of April, 2015, are hereby denied.
