ORDINANCE AMENDING CHAPTER 22, ARTICLE IX. - LICENSING AND REGULATION OF THERAPEUTIC MASSAGE, SEC. 22-431. - LICENSE RESTRICTIONS, PROOF OF LOCAL RESIDENCY

Background

Council recently received a request from a current massage enterprise owner, Massage Off Central, 11806 Aberdeen Street NE, to expand the local residency range to include Polk County in Wisconsin.  The local residency requirement was implemented with the original ordinance in 2012 to ensure that therapists licensed in the City were indeed local and working at the enterprise they were licensed to.  After reviewing the request with the Police Department, staff has no concerns expanding the residency requirement to include Polk County but suggests adding additional language of “within 150 miles of the City of Blaine” to allow for potential residency in other counties without having to amend the ordinance again.

First reading was held on January 21, 2016, and is being presented at this time for adoption.

Recommendation

Hold second reading and adopt proposed ordinance.

SEC. 22-431. - LICENSE RESTRICTIONS

(k) Proof of local residency required. In the case of a therapeutic massage enterprise, the licensee, managing partner, or manager of the licensed premise must show proof of residency in one of the following counties: Anoka, Carver, Chisago, Dakota, Hennepin, Isanti, Ramsey, Scott, Sherburne, Washington and Wright in Minnesota, and St. Croix, [or] Pierce, or Polk in Wisconsin or proof of residency within 150 miles of the City of Blaine. In the case of therapeutic massage therapists, the licensee must show proof of residing in one of the following counties: Anoka, Carver, Chisago, Dakota, Hennepin, Isanti, Ramsey, Scott, Sherburne, Washington and Wright in Minnesota, and St. Croix, [or] Pierce, or Polk in Wisconsin or proof of residing within 150 miles of the City of Blaine.
