Background
There is a 3 acre commercial outlot on the northeast corner of Legacy Creek Parkway and 125th Avenue that has remained undeveloped for several years.  At this time Stepping Stones Early Learning Center wishes to locate a facility on this property that is zoned B-2 (Community Commercial).  A conditional use permit and preliminary plat approval were granted by the City Council last month for this project.  
 
One lot is proposed with this plat that changes the existing outlot into a platted lot so a building permit could be issued on this site.  
 
Park dedication will be required for this lot at the rate of $8,289 per acre for a total park dedication fee of $24,867.  This fee must be paid prior to release of final plat mylars for recording at Anoka County.
 
The site previously paid the parcel's share for 125th Avenue/Legacy Creek Parkway/North Lakes Boulevard improvements at time of original platting.
 
The final plat is consistent with the approved preliminary plat, Resolution No. 14-162.
 
Recommendation
By motion, approve the Resolution.

Body
      WHEREAS, an application has been filed by Amy Wiechmann/Stepping Stones Early Learning Center as subdivision Case No. 14-0044; and
 
      WHEREAS, said case involves the division of land in Anoka County, Minnesota, described as follows:
 
OUTLOT G, LEGACY CREEK, ANOKA COUNTY, MINNESOTA.
 
      WHEREAS, the Blaine City Council granted preliminary plat approval on September 4, 2014, subject to the stipulations as contained in Blaine City Council Resolution No. 14-162; and
 
      WHEREAS, the applicant has submitted a final plat in general conformance with the approved preliminary plat.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that final plat approval for Legacy Creek 5th Addition per Section 74-43 of the subdivision regulations is hereby granted subject to the following conditions:
 
1.      Park dedication will be required for this lot at the rate of $8,289 per acre for a total park dedication fee of $24,867.  This fee must be paid prior to release of final plat mylars for recording at Anoka County
2.      The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreements and releases related to the approval, recording or administration of Legacy Creek 5th Addition.
