AUTHORIZING EXECUTION OF LIMITED USE PERMIT WITH THE MINNESOTA DEPARTMENT OF TRANSPORTATION FOR THE NAPLES STREET TRAIL (IMPROVEMENT PROJECT NO. 11-18)
 
Background
      The City of Blaine has received several inquiries from residents and local commuters requesting a trail be constructed along Naples Street from 95th Avenue north to the Park-N-Ride lot.  In response, the City of Blaine has applied for and secured an Energy Efficient Community Block Grant (EECBG) to fund the construction of said pedestrian trail.  The current alignment of Naples Street and the proposed trail both fall in existing Minnesota Department of Transportation (MnDOT) right-of-way.   MnDOT allows these facilities in their right-of-way as long as the municipality enters into a Limited Use Permit which will state the responsibilities of both parties.    
 
Recommendation
By motion, approve the resolution.
 
Body
WHEREAS, the City of Blaine intends to construct a trail from 95th Avenue to the Metro Transit Park-N-Ride which would be located in State of Minnesota Department of Transportation (MnDOT) right-of-way.
 
NOW, THEREFORE, BE IT RESOLVED, that the City of Blaine enter into a Limited Use Permit with MnDOT for the following purpose:
 
To construct, operate, and maintain a pedestrian trail within the right-of-way of Interstate Highway 35W of the State of Minnesota.  The City of Blaine shall construct, operate, and maintain said trail in accordance with the Limited Use Permit granted by MnDOT.
 
BE IT FURTHER RESOLVED, that the Mayor and the City Manager are authorized to execute the Limited Use Permit and any amendments to the Permit.
