APPROVE JOINT POWERS AGREEMENT WITH THE CITY
OF LINO LAKES FOR STREET LIGHTING OF THE SUNSET AVENUE AND 109TH AVENUE/APOLLO DRIVE ROUNDABOUT, IMPROVEMENT PROJECT NO. 15-18
Background
In 2016, Anoka County constructed a roundabout on Sunset Avenue at 109th Avenue/Apollo Drive which is a shared border between Blaine and Lino Lakes. The County installed fifteen street lights with the construction of the roundabout at the intersection. County policy states that maintenance of street lights and cost of electrical power to the street lights is the sole obligation of the Cities in which the installations are located.
This joint powers agreement (JPA) has been prepared between the City of Blaine and the City of Lino Lakes to share the cost of electrical power to the street lights and maintenance of the street lights within the Sunset Avenue right of way.
The Lino Lakes City Council is scheduled to consider approval of this JPA at their November 14, 2016 Council meeting. If approved by Lino Lakes, the Blaine City Council is asked to also consider approval of this JPA.
Recommendation
By motion, approve the resolution.

WHEREAS, the City of Lino Lakes and the City of Blaine consider it mutually desirable to share the cost of metered electrical power for the fifteen street lights constructed with Anoka County’s construction of a roundabout at the intersection of Sunset Avenue and 109th Avenue/Apollo Drive; and
WHEREAS, the City of Lino Lakes and the City of Blaine also consider it mutually desirable to divide the maintenance cost for the street lights within the Sunset Avenue roundabout right of way; and
WHEREAS, Minnesota Statutes Section 471.59 authorizes political subdivisions of the State to enter into joint powers agreements for the joint exercise of powers common to each; and
WHEREAS, said Agreement details the responsibilities of the City of Lino Lakes and the City of Blaine as to the costs associated with the street lights constructed with Anoka County’s construction of a roundabout at the intersection of Sunset Avenue and 109th Avenue/Apollo Drive.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
1. Joint Powers Agreement between the City of Lino Lakes and the City of Blaine with regards to street lighting of the Sunset Avenue and 109th Avenue/Apollo Drive roundabout is hereby approved.
2. The Mayor and City Manager are hereby authorized and directed to execute said agreement.
