Executive Summary
Per City Policy, surplus property must be declared as such by resolution prior to disposal, sale, or donation of the items.
Background
The Police Department Evidence Room continually takes in property for a variety of reasons. Examples of this include evidence related to a crime or abandoned/found property. The police department evidence staff have guidelines on when disposal of certain pieces of property in the evidence room can be destroyed, sold, or returned to the owners. The majority of the evidence disposal falls under statutory guidelines and can be dealt with only after a case has been resolved, including the completion of the appeals process. Due to unfortunate circumstances during 2020 related to the COVID-19 pandemic, virtually no property was sold or destroyed.
City Policy 2.01indicates that “DISPOSAL OF SURPLUS TANGIBLE (PERSONAL) PROPERTY” must, by resolution, be approved by the City Council for the sale of property. Per policy, we have a licensed vendor who will sell and/or dispose of property we designate. Also per policy, certain items may be donated to a non-profit organization.
All items are accounted for by our evidence procedures and evidence sheets, and satisfy the evidence guidelines for disposal. The number of items is quite large and some items may fall under “deliberative process privilege” and not for public information. If requested, a list can be developed as we work through the process.
The Police Department utilizes the services of Propertyroom.com for dispoal.
Financial Impact
All items sold by the vendor, monies received from the sales, and cash currently ready for release to the city, will be deposited in to the city’s general fund budget.
Staff Recommendation
By motion, adopt the Resolution declaring property as surplus.

WHEREAS, the City has developed a policy for disposal of surplus tangible property; and
WHEREAS, certain property has been reviewed by the evidence staff and it is determined that the items no longer need to be held in the evidence room and can be released to the licensed vendor who will sell and/or dispose of property we designate; and
WHEREAS, certain property has been reviewed by the evidence staff and it is determined that the items may be donated to a non-profit organization.
NOW, THEREFORE, BE IT RESOLVED, that the Blaine City Council acknowledge the evidence room surplus and authorize disposal per city policy.
