INITIATE VACATION OF DRAINAGE EASEMENTS AND UTILITY AND DRAINAGE EASEMENTS AND ORDER PUBLIC HEARING FOR OUTLOT B, NORTH OAKS PONDS EAST, AND OUTLOT A, NORTH OAKS PONDS EAST 2ND, VACATION NO. V17-09

 

Background

This is a City initiated vacation of drainage and utility and drainage easements.  One of the permit requirements for the open space project is to grant a conservation easement over the area in the project.  The conservation easement language however conflicts with existing easements that were platted with the original property.  This vacation will remove the underlying easements and a new document will dedicate a conservation easement over them.

Recommendation

By motion, adopt the Resolution.

 

Body

WHEREAS, the City Council has statutory authority to initiate the vacation of drainage easements over a portion of Outlot B, North Oaks Ponds East, and the vacation of utility and drainage easements over a portion of Outlot A, North Oaks Ponds East 2nd; and

 

                     WHEREAS, the Engineering Department has reviewed the proposed vacation and recommends that the City Council hold a Public Hearing on the requested vacation.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

 

1.                     The Council will consider the vacation of easements.

 

2.                     A Public Hearing shall be held on the proposed vacation at 7:30 PM on the 1st day of February, 2018 and the City Clerk shall give mailed and published notice of such hearing and vacation as required by law.
