The Planning Commission voted unanimously to approve the conditional use permit. One written comment was received in support of the request.
 
Background
The applicant would like to construct a detached accessory building in the side yard of a 0.69 acre parcel in an R-1 zone. The detached garage (enclosed) would be 26' x 30', with a 26' x 16' carport attached to the front of the garage. The total area of the accessory building space is 1,196 square feet. A conditional use permit is required to build over 1,000 square feet of garage space.
 
The reason for the construction is because the former detached garage, which was located in the same location as the proposed garage, collapsed due to snow and was a total loss. The new garage will be located on the existing concrete slab and the concrete drive leading up to the garage will also remain.
 
The applicant intends to store equipment such as vehicles, lawn tractor, snowmobile, ATV, and general yard tools in the structure.
 
The applicant is in the process of purchasing a small amount of land from his neighbor to the south in order to meet the setback requirement on the southern property line.  In the instance that the applicant is not able to purchase the property to the south prior to a building permit being issued, the proposed structure (including carport) will need to meet the required 5 foot side yard setback from the existing property line.

Recommendation
By motion, approve the Resolution.
 
Body
      WHEREAS, an application has been filed by Kenneth Snyder as Conditional Use Permit Case File No. 14-0060; and
 
      WHEREAS, a public hearing has been held by the Blaine Planning Commission on November 12, 2014; and
 
      WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and
 
      WHEREAS, the Blaine City Council has reviewed said case on December 4, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 29.34(i) of the Zoning Ordinance to allow for construction of a 1,196 square foot detached garage based on the following conditions:
 
1.      The structure to match the color of the house.
2.      A building permit must be obtained prior to construction of the building.
3.      The new accessory building space to be used for personal storage only.
4.      The accessory building to be generally located as shown on attached sketch and meeting all required setbacks.
5.      If the applicant is not able to purchase the property to the south prior to a building permit being issued, the proposed structure (including carport) will need to meet the required 5 foot side yard setback from the existing property line.
6.      The accessory building is limited to 1,196 square feet and a second floor is not permitted.
