Title

PUBLICATION OF THE TITLE AND SUMMARY OF ORDINANCE 16-2350 AMENDING CHAPTER 70 - STREETS, SIDEWALKS AND OTHER PUBLIC PLACES ARTICLE II. - SPECIAL EVENTS OF THE MUNICIPAL CODE OF THE CITY OF BLAINE

 

Background

Ordinance 16-2350 was adopted earlier in the agenda on May 19, 2016.  Minnesota Statute 412.191, Subd. 4, provides for publication of the title and summary of an ordinance in the case it is lengthy, if the City Council determines that publication of the title and a summary would clearly inform the public of the intent and effect of the ordinance.  As Ordinance 16-2350 is lengthy staff is recommending adoption of the proposed summary resolution.  The entire ordinance is available for inspection during regular office hours at City Hall and can be forwarded upon request.

 

Recommendation

Adopt the resolution providing for a summary publication of Ordinance 16-2350. 

 

Body

                                          WHEREAS, City Code states if the City Council of the City of Blaine determines, pursuant to Minn. Stat. § 412.191, subd. 4, that publication of the title and a summary of an ordinance would clearly inform the public of the intent and effect of the ordinance, the Council may, by a four-fifths vote of its membership, direct that only the title of the ordinance and a summary be published with notice that a printed copy of the entire ordinance is available for inspection by any person during regular office hours in the office of the City Clerk. The publication of the title and summary shall be deemed to fulfill all legal publication requirements as completely as if the entire ordinance had been published; and

 

WHEREAS, the City Council of the City of Blaine has reviewed the text of the Ordinance Summary incorporated herein for Ordinance 16-2350 relating to Amending Chapter 70 - Streets, Sidewalks and Other Public Places Article II. - Special Events of the Municipal Code of the City of Blaine and is as follows; and

 

                     Chapter 70, Article II - adds term “special events” and identifies zoning and land uses where ordinance applies

                     Sec. 70-41 - Definitions. - clarifies and expands definitions of special events

                     Sec. 70-42 - License. - creates application requirements to obtain a special events license, including State and County required permits, fees, and traffic-control plans

                     Sec. 70-43 -Fees for usage and maintenance of public property. - adds fees for temporary intersection lighting, portable restrooms, garbage and recycling receptacles if required

                     Sec. 70-44 - Exceptions. - Outlines exceptions to the special event ordinance, including school district activities, Blaine Festival, and 3M Championship

                     Sec. 70-45. - Requirements for a special event license. - outlines requirements including application, adjacent property owner consent, liability insurance, indemnity agreement, review, recommendation and notification process, allowance for conditional use permit process if needed, and requirement for Council approval for regional recreational zoned property

                     Sec. 70-46. - Issuance of license; conditions. - outlines review and conditions for obtaining a special event license as well as reserving the right to modify conditions if warranted

                     Sec. 70-47. - Trash management/recycling required. - requires proper trash and recycling options proportional to trash collection services

                     Sec. 70-48. - Violation; penalty. - outlines penalties for violations of the ordinance and allows for revocation of license under false pretenses

                     Sec. 70-49. - Duties of special event coordinator. - establishes designation of special event coordinator who will ensure license directions and conditions are met, including clean up, litter disposal, and allows for invoicing for clean up costs if not done; requires traff-control personnel or barricades if necessary, and indemnifies the City from all claims

                     Sec. 70-50. - Notice to abutting property owners. - allows for notice to abutting property owners for events such as bicycle racing, foot racing, and marathons to notify property owners along the parade/race route at least 48 hours in advance of event identifying the dates, times, and routes 

 

                                          WHEREAS, the City Council of the City of Blaine determined that the Ordinance Summary clearly informs the public of the intent and effect of Ordinance 16-2350.

 

                     THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine herby directs that the title and Ordinance Summary of amendments shall be published in the official City newspaper and herby gives notice that printed copies of the complete Ordinance are available for inspection by any person during regular office hours at the Office of the Blaine City Clerk, and that a copy of the entire text shall be posted in the official posting place in the City, and further directs that a copy of this Resolution, as enacted will be published.
