AMENDING RESOLUTION NO. 03-248, ESTABLISHING THE FEES FOR PARK DEDICATION FOR THE CITY OF BLAINE.
 
Background
On December 18, 2003, Resolution 03-248 was approved by the City Council and directs that on January 1 of each year park dedication fees shall be adjusted. Park dedication fees are placed in the fee schedule that is updated annually by Ordinance rather than a Resolution, requiring a public hearing and, first and second readings.  
 
The adjustment is determined by the percent of increase in the fair market value of undeveloped land within the City and must not exceed a 10% increase. The Park Board has recommended to the City Council an increase in Park Dedication fees based on the following:
·      Dedication fees have not increased for the past 3 years and at the same time, according to the County Assessing Department, Blaine's development of unimproved land is ahead of all County cities.  
·      Blaine is ranked 12th out of 13 metro cities recently surveyed in residential park dedication fees and ranked in the middle of the cities for commercial fees.
·      An analysis conducted by the Planning Department and based on the City's 2030 Comp Plan showed that the City's estimated development for the period 2010-2015 should average 319 residential units and 30 acres of commercial/industrial per year.  Future park, open space and trail development should keep pace with this growth through measured annual increases in park dedication fees.
 
Therefore, staff is recommending City Council adopt the following increases in park dedication fees for 2012 and as referred by the Park Board.

Ordinance No.12-2240 will retain the 65/35 split in residential fees between parks and open space.

ADDING SECTION 74-81(g)(4)g TO THE MUNICIPAL CODE OF THE CITY OF BLAINE
THE CITY OF BLAINE DOES ORDAIN:   (Added portions are underscored and deleted portions are shown in brackets with overstrike.)
 
Section 74-81(g)(4)g.  Blaine Resolution No. 03-248 provides that park dedication fees shall be adjusted beginning January 1 of each year by the percent of increase in the fair market value of undeveloped land within the City, with an annual increase not to exceed 10%.  The fair market value average of unimproved land has increased by a minimum of 5% in 2011 and park dedication fees for 2012 shall be increased.  
 
      1.  2012 Park Dedication Fees.  The following fees are hereby adopted for 2012, and shall be effective for final plats, plat waivers and building permits approved or issued after January 1, 2012, except for those final plats that are part of previously approved developments, which have specific language limiting park dedication rate increases approved by the City Council in previous development agreements.

2.  Use of Fees.  The fees collected for residential development shall be distributed 65% to park development and 35% to open space development.  100% of commercial and industrial fees shall be used for park development.  The cost for acquisition of land and construction of trails outside of parks shall be funded from the open space portion of the park dedication fee.
