A RESOLUTION DETERMINING THAT S.R. WEIDEMA IS NOT A RESPONSIBLE BIDDER

WHEREAS, the City of Blaine and S.R. Weidema previously entered into a Contract for completion of Blaine Improvement Project 15-22, S.R. Weidema’s work on said improvement project resulted in a sewage backup into 19 Blaine residences; and,
WHEREAS, S.R. Weidema has defaulted and has breached its contract with the City of Blaine relative to Blaine Improvement Project 15-22, and S.R. Weidema has failed to complete said improvement project which is now the subject of pending litigation between S.R. Weidema and the City of Blaine; and,
WHEREAS, pursuant to an advertisement for bids for Blaine Improvement Project 17-07, bids were received on March 27, 2018, opened and tabulated according to the law, and S.R. Weidema’s bid was received in an amount of $2,958,989.31; and,
WHEREAS, pursuant to Section 6.06 of the Blaine Charter, the City Council has the authority to reject “any and all bids”.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Blaine, as follows:
1. The Whereas clauses above stated are incorporated herein by reference.
2. S.R. Weidema is in default of its contract with the City of Blaine for the work on Blaine Improvement Project 15-22.
3. S.R. Weidema has breached its Contract with the City of Blaine on Blaine Improvement Project 15-22.
4. Despite demand, S.R. Weidema has failed to complete the work set forth within its Contract with the City of Blaine on Blaine Improvement Project 15-22.
5. S.R. Weidema and the City of Blaine are currently in active litigation with respect to S.R. Weidema’s work on Blaine Improvement Project 15-22.
6. S.R. Weidema lacks the integrity, skill and ability to adequately complete Blaine Improvement Project 17-07.
7. It is unlikely S.R. Weidema would faithfully and satisfactorily complete the work on Improvement Project 17-07.
8. Based upon the foregoing, it is hereby determined that S.R. Weidema is not a responsible bidder.
