Background
The applicant took over the veterinary outpatient clinic at 625 County Road 10 NE in 2007 under the name of Companion Veterinary Hospital. The applicant was not aware of the Conditional Use Permit requirements prior to purchasing the building in 2007 from the former owner. However, after learning of the CUP requirements they have spent the last several years trying to establish the business in order to comply. These improvements (site work and fire suppression) were required in the original Conditional Use Permit to be completed initially in 2007.
 
In November of 2011 the City Council extended the time period for two years on the required parking lot and landscape improvements. The Council also extended the timeframe for the required fire suppression but only for one year. At the same time however the City Council requested that the applicant provide, within 6-months, a specific plan and timetable for completing the building fire suppression system.
 
The City Council discussed this issue with the applicant (Sharyl Gandara) at the May 17th City Council workshop. The total project cost to add the fire suppression system, based on bids obtained by the applicant, is $46,000. At that workshop several options were presented by staff with the council consensus being to move forward with providing City/EDA assistance in the following manner:
 
· $23,000 special assessment (plus $230 assessing fee) paid back by the property owner over a 10 year period at 5% interest
· $23,000 matching grant (Fire Suppression Grant)
 
The funds would be drawn from the EDA from either cash reserves or pooled TIF dollars. Any project expenses exceeding $46,000 would need to be paid directly by the applicant. The applicant has signed an assessment agreement and is prepared to move forward based on the schedule above. It would be expected that the work would be completed prior to adopting the actual assessment on November 1st.

WHEREAS,; the City of Blaine, through the issuance of a Conditional Use Permit,  has required the installation of a automatic fire suppression system for the property at 625 County Road 10 and further described as PIN # 31-31-23-43-0045 and
 
WHEREAS, the owner of said property has requested financial assistance in the form of a special assessment to install a fire suppression system on said property and
 
WHEREAS, the owner of said property has entered into an Agreement for Levy of Special Assessments and Waiver of Right to Appeal Levied Special Assessments for the installation of a fire suppression system and
 
WHEREAS, the cost of the system to be installed, based on bids obtained by the property owner, is $46,000 with $23,000 of that portion to be special assessed, plus a $230 assessment fee, once the owner completes the work
 
NOW, THEREFORE, BE IT RESOLVED that the Blaine City Council as follows:
 
1.      The total cost of the improvements (fire suppression system) is estimated at $46,230.
 
2.      The amount to be assessed is hereby declared to be$23,230.00. An EDA matching Fire Grant of $23,000 will also be applied towards the cost of the improvements.
 
3.      The City Manager shall forthwith calculate the proper amount to be specially assessed for the improvement against the property at 625 County Road 10 NE and further described as PIN # 31-31-23-43-0045, within the City of Blaine, as provided by law, and shall file a copy of such proposed assessment in his office for public inspection.
 
4.      A hearing shall be held on the 2nd day of August, 2012, in the Council Chambers of Blaine City Hall at 8:00 PM, or as near a time possible, and at such time and place all interested persons owning properly affected by the proposed special assessment shall be given the opportunity to be heard with reference to such assessment.
 
5.      The City Manager shall give published and mailed notice of such hearing as required by law.
