Planning Commission
The Planning Commission voted unanimously to approve the rezoning and preliminary plat. One resident submitted a comment and spoke at the public hearing with concerns about privacy, wildlife and fencing.
 
Background
Kayak Remodeling and Redevelopment is proposing an infill plat on a 2.39 acre property that is on the southeast corner of 89th Avenue and Baltimore Street.  The proposal requires a rezoning for a portion of the property and approval of a preliminary plat.  
 
Preliminary Plat
The proposed plat contains six lots and will be known as Madelyn Cove.  The existing duplex will remain on Lot 1 and all setbacks are met for that structure and the accessory structure in the rear yard.  All of the lots meet the minimum lot size requirement in the R-1 and R-2 zoning districts.  
 
Park dedication will be required for the 5 new lots being proposed within Madelyn Cove.  Please note the developer does not need to pay park dedication for the Lot 1 as it is an existing structure that has already paid this fee.  The City's current park dedication rate for single family lots is $3,094 per unit.  A total park dedication fee of $15,470 would become due prior to final plat mylars being released to the developer for recording at Anoka County.  
 
It was noticed on the plan that the developer intends to plant only one tree on each lot, and the City's normal landscaping requirements for the R-1 (Single Family) zoning district is two trees per lot.  Additionally, most of the site's 59 trees will be removed as part of site grading. Based on the City's tree preservation requirements 15 of those will need to be replaced. This can be accomplished by planting three (3) trees per lot.
 
This plat proposes to have four new driveways access 89th Avenue.  Currently 89th Avenue is contained inside of Minnesota Department of Transportation right-of-way and as such MNDoT has reviewed the proposed plat and prepared a review letter.  The developer will need to obtain all necessary MNDoT permits to allow for the construction of the driveways and the extension of sanitary sewer and watermain to each lot.  The City and MNDot are currently reviewing the process to turnback a portion of MNDoT right-of-way that contains 89th Avenue to the city.  
 
Developer will need to obtain a Coon Creek Watershed permit prior to commencing any site grading.
 
Recommendation
By motion, approve the Resolution.

      WHEREAS, an application has been filed by Kayak Remodeling and Redevelopment as subdivision Case File No. 14-0008; and
 
      WHEREAS, said case involves the division of land described as follows:
 
PARCEL A
LOT 21, SPRING LAKE PARK SHORES ADDITION, EXCEPT THE EAST 150 FEET THEREOF, ANOKA COUNTY, MINNESOTA; AND
 
PARCEL B
LOT 40, SPRING LAKE PARK SHORES ADDITION, ANOKA COUNTY, MINNESOTA.
 
      WHEREAS, the Blaine Planning Commission has reviewed said case file on March 11, 2014; and
 
      WHEREAS, the Blaine Planning Commission has recommended subdivision Case File No. 14-0008 be approved subject to certain stipulations; and
 
      WHEREAS the Blaine City Council has reviewed said case file on April 3 and 17, 2014.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that preliminary plat approval per Section 74-42 of the subdivision regulations is hereby granted to Kayak Remodeling and Redevelopment permitting preparation of a final plat for approval per Section 74-43 subject to the following conditions:
 
1.      Park dedication will be required for the 5 new lots being proposed within Madelyn Cove.  Please note the developer does not need to pay park dedication for the Lot 1 as it is an existing structure that has already paid this fee.  The City's current park dedication rate for single family lots is $3,094 per unit.  A total park dedication fee of $15,470 would become due prior to final plat mylars being released to the developer for recording at Anoka County.
 
2.      Most of the site's 59 trees will be removed as part of site grading. Based on the City's tree preservation requirements 15 of those will need to be replaced. This should be accomplished by planting three (3) overstory trees per lot (Lots 2-6).
 
3.      Developer to obtain all required permits from Minnesota Department of Transportation prior to any site work.
 
4.      Developer to obtain a permit from Coon Creek Watershed District prior to any site work.
 
5.      Standard WAC (Water Access) and SAC (Sewer Access) fees will be due with each home constructed.
6.      Execution and recording of a Development Agreement outlining the developer responsibilities for grading and development of the property.
