Title
AN ORDINANCE AMENDING CHAPTER 18, ARTICLE VIII - RESIDENTIAL MAINTENANCE CODE, CITY OF BLAINE CODE OF ORDINANCES
 
Background
In 2007 the rental dwelling licensing requirements were expanded to include single family attached and detached dwelling units.  In order to accomplish this, the requirements for licensing rental dwellings were removed from Article VIII - Residential Maintenance Code and a new Article X - Licenses for Rental Dwellings was written and ultimately adopted by Council.
 
Since the adoption of this new article several issues have been identified with the separation of the license requirements from the maintenance code, which has lead to some problems with enforcement.  Staff believes that with a few minor housekeeping changes these issues can be corrected.  The following are the general areas that need addressing:
 
1.      Minor changes to the definition section in both Article VIII and X.
2.      Linking both Article VIII and X together.
3.      Reinstating language for a Resident Agent which was previously in the code.

ARTICLE VIII. RESIDENTIAL MAINTENANCE CODE
 
DIVISION 1. GENERALLY
 
Sec. 18-301 Definitions.
Family An individual or a group of two or more persons each related by blood, marriage, adoption, or foster care arrangement living together as a single housekeeping unit, or a group of not more than four (4) persons not so related, maintaining a common household, and using common cooking and kitchen facilities, exclusive of usual servants.   means one of the following definitions:
(1)      A person or persons related by blood, marriage, or adoption, together with any such person's domestic servants, or gratuitous guests, maintaining a common household in a dwelling unit;
(2)      Group or foster care of not more than six wards or clients by an authorized person, related by blood, marriage or adoption, together with any such person's domestic servants or gratuitous guests, all maintaining a common household in a dwelling unit approved and certified by the appropriate public agency;
(3)      A group of not more than five persons not related by blood, marriage or adoption maintaining a common household in a dwelling unit.
 
Dwelling means a structure or portion thereof, designated or used predominantly for residential occupancy of a continued nature, including one family dwellings, two family dwellings, and multiple family dwellings of three or more family dwelling units either rental or owner occupied, but not including hotels and motels.
 
 
 
Rental dwelling means any structure or portion thereof which is designated or used for residential occupancy by one or more persons who are not the owner or a member of the owner's family.  Rental dwelling includes commercial living facilities, not governed by state licensing requirements.
 
Sec. 18-322 - Rental Dwelling License Required.
All rental dwellings shall be licensed as required by Blaine Code of Ordinance Chapter 18, Article X, Licenses for Rental Dwellings.
