Background

In 2014, Dr. Ross Elton opened a new veterinary clinic on the southeast corner of Aberdeen Street and 125th Avenue after receiving approval of a conditional use permit. The site is zoned B-2 (Regional Commercial) and animal hospitals are considered conditional uses in this district. The clinic is located within a tenant space in an existing multi-tenant building. The tenant space is on the west end of the building. At this time, he has come to an agreement with the owner of the building to expand into the adjacent tenant space (1506 125th Avenue NE). This expansion requires a conditional use permit amendment.
This item was not brought to the Planning Commission for their review due to the fact that this is an existing business that is proposing to expand within the same building. The surrounding neighborhood (within 350 feet) was notified of this application and the public hearing will be held by the City Council at this meeting.
Dr. Elton has stated that he has no issues with abiding by the original conditional use permit conditions. So, as a reminder, there will be no boarding of dogs at this location unless medically necessary, the hours of operation will be Monday through Saturday from 8:00 a.m. to 6:00 p.m., and there will be 3 employees at the clinic along with Dr. Elton.
Parking would generally be the City’s main concern with a use such as this but this center has an adequate number of stalls for this use and the other retail uses in the building.
As a reminder all signage and temporary signage is issued under a separate permit.
Recommendation
By motion, approve the Resolution.

WHEREAS, an application has been filed by Northgate Square LLC as Conditional Use Permit Amendment Case File No.20-0028; and
WHEREAS, said case involves the land described as follows:
LOT 6, BLOCK 1, NORTHGATE MALL ADDITION
WHEREAS, the Blaine City Council has reviewed said case on August 17, 2020.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit Amendment is hereby approved per Section 30.24(a) of the Zoning Ordinance to allow a conditional use permit amendment to expand an existing business (animal hospital) into an adjacent tenant space in a multi-tenant retail building in a B-3 (Regional Commercial) zoning district based on the following conditions:
1. Boarding of dogs is not allowed at this location unless medically necessary.
2. All permanent and temporary signage is issued under a separate permit.
3. If there are any changes to the operation of the vet clinic, such as boarding of dogs, a conditional use permit amendment will be necessary.
4. No outside kennels or permanent exercise areas are allowed.
5. No cremation or disposal of dead animals is allowed on the premises.
6. City is supportive of sound proofing the interior (shared) wall as a suggestion to the tenant or property owner.
7. A C.O. (Certificate of Occupancy) is required from the City prior to occupying the space. Permits (building and fire) may be needed for interior remodeling and other tenant improvements.
