GRANTING A CONDITIONAL USE PERMIT TO ALLOW FOR AN OUTDOOR EVENT TO BE HELD ON SATURDAY, MAY 21, 2016 THAT INCLUDES OUTDOOR MUSIC AND FOOD IN A B-3 COMMERCIAL ZONING DISTRICT AT TWIN CITIES HARLEY-DAVIDSON, 1441 85TH AVENUE NE

 

Background

On May 18, 2016, staff learned that Twin Cities Harley-Davidson is planning an outdoor event at their location on 1441 85th Avenue NE.  The applicant, Douglas Witkowski, Marketing Manager for Twin Cities Harley-Davidson, had contacted staff in March inquiring about the process to hold events at their site and while staff had responded three times with preliminary concerns about how parking would be handled no response was given and it was assumed the event(s) were not going to occur.  While the City likes to support and accommodate businesses in Blaine by allowing special events, these events can produce resident concerns regarding noise, parking and the sale and containment of alcohol.  This event would have required the traditional Conditional Use Permit process for this reason so staff could notify the surrounding neighborhood and solicit input.  With the event being two days away proper notification is not possible, so one of the recommended conditions is to notify the surrounding neighborhood of the event with hand-delivered flyers directly from the applicant.

 

The event is to include a stage with live music, food and alcohol.  The event will be held between 11:00 a.m. and 5:00 p.m., with beer between noon and 4:00 p.m. and live music from 1:00 to 5:00 p.m.  The site is zoned B-3 Community Commercial.  Attached is a flyer and sketch with some details outlining the event. 

 

The applicant is not able to estimate the number of attendees, so with regard to parking, staff cannot comment that the plan is sufficient.  Community Standards has reviewed the proposed plan and has outlined to the applicant areas where parking cannot occur in order to maintain emergency access.  The applicant has also applied for a tent permit which will be inspected by Community Standards as well as any food preparation that may occur in the tent for fire safety.  The Police Department will be posting no parking on both sides of Baltimore Street to ensure access as well. 

 

The applicant has contracted with Route 65 Pub & Grub regarding the sale and containment of alcohol and has provided proper notice including proof of valid caterer’s permit and liquor liability insurance naming the City as additional insured.  Hours for sale of alcohol shall be between noon and 4:00 p.m.

 

Staff has notified the applicant of the ability to stop the event should they receive complaints from the surrounding neighborhood.  Staff has also discussed the new special event permit requirements that the Council will be reviewing at tonight’s meeting so future events can occur through the proper permitting procedure.

 

Recommendation

By motion, approve the Resolution.

                     WHEREAS, an application has been filed for a Conditional Use Permit by Twin Cities Harley-Davidson; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on May 19, 2016.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 29.80 of the Zoning Ordinance to allow an outdoor event to be held on May 19, 2016 that includes live music, food, and alcohol at Twin Cities Harley-Davidson in a B-3 Commercial zoning district at 1441 85th Avenue NE based on the following conditions:

                     

1.                     All music that is amplified or live cannot start earlier than 1:00 p.m. and must end at 5:00 p.m. on the day of the event.  The stage and sound speakers must be directed west towards Highway 65.

2.                     The applicant to obtain the proper permits for the event from the Community Standards Department and all portions of the event must comply with the current Fire Code, including tent/canopy permits. 

3.                     The applicant to work with the City of Blaine Police and Community Standards Departments to determine security/safety requirements, including allowing access for emergency vehicles. 

4.                     Proof of caterer’s permit and liquor liability insurance naming the City as additional insured for the service of alcohol on site.

5.                     The applicant must hand-deliver flyers and contact information to the neighboring residential properties informing them of the event prior to the start of the event.

6.                     All parking must occur as shown on the attached plan.  Parking is to occur on hard-surfaced areas only.
