A RESOLUTION DETERMINING S.R. WEIDEMA TO BE A RESPONSIBLE BIDDER

 

Body

                     WHEREAS, Resolution 18-65, passed by the City Council on April 19, 2018, determined that S.R. Weidema (“Weidema”) was not a responsible bidder based upon damages caused to 19 Blaine residences from sewage backup during Blaine Improvement Project 15-22 (Hastings Street Improvement Project). 

                     

                     WHEREAS, The City and homeowners Arafa Ahmed, Michael Blood, Donna-Lee Borovansky, Jessica Bruneau, John Haff, Caleb Davies, Lisa and Thomas Dorn, Vince Lor, Peter and Karen Moberg, Michael Morehouse, Dan and Wendy Sanders, Tom Tucker and Stephen Walthour (“the homeowners”) commenced separate lawsuits against S.R. Weidema for damages. 

 

         WHEREAS, Weidema brought a lawsuit against the City based upon the City’s decision not to award Weidema Improvement Project No. 17-07 (Lever Street Project) based upon the City’s determination that Weidema was not a responsible bidder.

 

                     WHEREAS, the lawsuits between the City, Weidema and the homeowners have been resolved to the satisfaction of the City.

 

                     NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Blaine, as follows:

 

                     1.                     The Whereas clauses above stated are incorporated herein by reference.

 

                     2.                     Based upon the successful resolution of those lawsuits, the City has determined that the issues that gave rise to Resolution 18-65 have been resolved and Weidema will be considered a responsible bidder on projects let for bid in the City of Blaine.
