Background
 
Hamline Avenue has exceeded its service life and has deteriorated to a point where it is becoming difficult to maintain and now requires a complete reconstruction.  As the street lies within the corporate boundaries of both the City of Lexington and the City of Blaine, staff has been working with the City of Lexington on a Joint Powers Agreement (JPA) to lay out the framework for an agreement to reconstruct Hamline Avenue in 2012 from Edgewood Road NE to Patriot Lane NE.
 
The main points of the JPA are as follows:
·      All costs for the project, including engineering design, construction inspection and project administration will be split between Blaine and Lexington based on each City's percentage of front footage along the project.
·      Lexington will provide all survey, engineering design, construction inspection and project administration services for the project.
·      Blaine staff will be included in determining the general scope and design parameters of the project and will inspect the construction as necessary to ensure the project meets the City's standards.
·      Both Cities shall approve the final design prior to bidding of the project.
 
It is recommended that both cities share responsibilities and costs as outlined in the attached JPA.  If the JPA is approved by Council, staff will begin to work with Lexington on the general design parameters and preparation of a Feasibility Report.
 
Recommended Council Action

APPROVE JOINT POWERS AGREEMENT WITH THE CITY OF LEXINGTON FOR THE RECONSTRUCTION OF HAMLINE AVENUE NE FROM EDGEWOOD ROAD NE TO PATRIOT LANE NE
IMPROVEMENT PROJECT NO. 10-13
 
 
      WHEREAS, the City of Lexington and the City of Blaine desire to jointly cause the improvements of reconstructing the existing street on Hamline Avenue from the intersection at Edgewood Road to the intersection at Patriot Lane for the benefit of the traveling public; and
 
      WHEREAS, Minnesota Statutes Section 471.59 authorizes the City of Lexington to enter into an Agreement with the City of Blaine to provide for the reconstruction of Hamline Avenue from Edgewood Road to Patriot Lane for the joint exercise of powers common to each; and
 
      WHEREAS, said Agreement details the responsibilities of the City of Lexington and the City of Blaine as to the costs associated with the design, construction and related activities of the Project.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
 
1.      Joint Powers Agreement between the City of Lexington and the City of Blaine with regards to the reconstruction of Hamline Avenue is hereby approved.
2.      The Mayor and City Manager are hereby authorized and directed to execute said agreement.
