Background
At the City Council workshop of September 13, 2012 the City Council reached a consensus that a policy should be brought forward regarding concert requests at the NSC (National Sports Center). The attached resolution includes those comments and concerns discussed by the City Council as well as some items inserted by staff for City Council consideration. In general the policy has the following elements:
 
·      This Policy, except as noted below, shall apply to all outdoor music concerts held at the NSC where the musical performance is the primary event and where a Conditional Use Permit (CUP) is required.
·      This Policy shall not apply, and a CUP will not required, for outdoor music concerts that are part of an already approved outdoor event and where the music performance is not the primary focus such as an opening or closing ceremony for sporting events, tournaments or City of Blaine community festivals.
·      This Policy shall not apply, and a CUP is not required, for outdoor music concerts where attendance is capped at no more than 1,500 attendees and where the concert will end before 9:30 PM
·      The City will not approve a CUP for outdoor music concerts for more than two consecutive days/nights or for more than five (5) days/nights in any given calendar year.
·      Hours of approved outdoor music concerts to be between 10:AM and 10:30 PM unless further limited by CUP
·      All outdoor music concerts are to be ticketed events and to be capped at attendance (total tickets distributed) of not more than 12,000 for single event and 20,000 for an all-day event
·      There shall be no alcohol sales outside or inside the concert venue.
·      Security/Traffic Control Plan must be in place with Blaine Public Safety for all outdoor music concerts.
·      Security and Traffic Control Agreement for onsite Public Safety required for all events where attendance is expected over 10,000.
·      No overnight camping is allowed.
·      No tailgating allowed.
·      Stage amplification to be part of a Noise Management Agreement that allows Blaine Public Safety to request and receive full cooperation to lower the amplification and noise impacts.  
 
Recommendation
By motion, approve the Resolution.
 
Body
WHEREAS, the Blaine City Council has been requested to consider approvals for outdoor concerts at the National Sports Center (NSC) and;
 
WHEREAS, the Blaine City Council has discussed the need for policy guidelines that would assist staff and council in those requests and;
 
WHEREAS, the Blaine City Council has reviewed and considered the policy statements included in this resolution at their October 18, 2012 City Council meeting.
 
NOW, THEREFORE, BE IT RESOLVED, that the Blaine City Council hereby adopts the following NSC Concert Policy Guidelines, in Resolution form:
