Background
Paulson Construction is coming to the end of the build out in Amen Corner 1st and 2nd Additions, which were platted in 1998 and 2002. The Amen Corner development is located on the northwest corner of Radisson Road and 109th Avenue.
Paulson Construction is proposing to replat one of the two remaining vacant lots in Amen Corner 2nd Addition because locating a house pad on the existing lot has proven difficult given setback requirements in this development. The vacant lot that is being replatted has an address of 14039 Amen Circle and it is directly adjacent to a portion of the common lot (outlot in Amen Corner 2nd Addition) that surrounds the detached townhomes in this development. The outlot is owned by the Amen Corner homeowners association. What is being proposed at this time is replatting the existing lot and incorporating a portion of the outlot that is adjacent to the lot to provide enough room for a house pad in this location. The drawings attached to this item should provide a clear picture as to what is being proposed.
Because the Amen Corner homeowner’s association is an agreement with the replatting effort, staff is recommending approval of the final plat being proposed. The plat creates one revised lot that will be built on and a new version of Outlot A, which will continue to be owned as common property by the homeowners association. The new plat will be called Amen Corner 3rd Addition. A portion of an existing drainage and utility easement on Outlot a will need to be vacated prior to the issuance of a building permit for the new lot.
Park dedication is not required for this new lot as park dedication was already paid for the unit in 2002.
The final plat is consistent with the approved preliminary plat, Resolution No. 98-276.
Recommendation
By motion, approve the Resolution.

WHEREAS, an application has been filed by Paulson Construction as subdivision Case No. 18-0021; and
WHEREAS, said case involves the division of land in Anoka County, Minnesota, described as follows:
Outlot A, Amen Corner Second Addition, Anoka County, Minnesota, and
Lot 7, Block 2, Amen Corner Second Addition, Anoka County, Minnesota, except that part of said Lot 7 described as follows: beginning at the most easterly corner of said Lot 7; thence North 50 Degrees 04 Minutes 11 Seconds West (assumed bearing) along the Northeasterly line of said Lot 7 a distance of 39.97 feet to an angle point on said Northeasterly line; thence South 35 Degrees 28 Minutes 43 Seconds East 31.70 feet; thence North 89 Degrees 15 Minutes 21 Seconds East 12.25 Feet to the point of beginning.
WHEREAS, the Blaine City Council granted preliminary plat approval on December 18, 1997, subject to the stipulations as contained in Blaine City Council Resolution No. 98-276; and
WHEREAS, the applicant has submitted a final plat in general conformance with the approved preliminary plat.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that final plat approval for Amen Corner 3rd Addition per Section 74-43 of the subdivision regulations is hereby granted subject to the following conditions:
1. The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreement and releases related to the approval, recording or administration of Amen Corner 3rd Addition.
2. Building permits cannot be issued for this lot until the mylars have been released for recording at Anoka County, and a portion of the existing drainage and utility easement on Outlot A is vacated.
