RECEIVE PETITION AND ORDER PUBLIC HEARING FOR VACATION OF REAR DRAINAGE AND UTILITY EASMENT ON LOT 12, BLOCK 1, THE SANCTUARY 5TH ADDITION, VACATION NO. V11-06
Background
A petition dated October 17, 2011, was submitted to the City by Amy Hennen and Scott Nielsen of 2751 104th Court NE requesting vacation of the rear drainage and utility easement for Lot 12, Block 1, The Sanctuary 5th Addition. This vacation is being requested due to a revised wetland delineation stemming from a swimming pool installation. The applicant is a single property owner who represents 100% of the affected property abutting this easement.

Recommendation
By motion, approve the Resolution.
Body
WHEREAS, the City Council has received a petition dated the 17th day of October, 2011, requesting vacation of rear drainage and utility easement for Lot 12, Block 1, The Sanctuary 5th Addition; and
WHEREAS, the Engineering Department has reviewed the petition and recommends that the City Council hold a Public Hearing on the requested vacation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
1. The Council will consider the petitioned vacation of rear drainage and utility easement for the property owner.
2. A Public Hearing shall be held on the proposed vacation at 8:00 p.m. on the 1st day of December, 2011, and the City Clerk shall give mailed and published notice of such hearing and vacation as required by law.
