Background

John’s Auto Parts, up until 2013, operated a vehicle reduction yard at 10588 Central Avenue NE. Their use began in 1961 and was expanded many times through subsequent approvals by the City of Blaine, mostly in the form of Conditional Use Permits. In 2013 John’s Auto closed and the owner, Harold Haluptzok, leased the facility to LKQ, a national auto recycler which operated the use until early December.

 

Mr. Haluptzok reached an agreement with Copart of Connecticut, another national auto recycler, for them to purchase the site and reopen later this winter. The CUP amendment that is proposed would transfer the rights and obligations under the existing CUP Resolution No. 11-102 from John’s Auto to Copart. Because there are some variations in the operations model (such as no crushing of vehicles) a new resolution, with conditions that reflect those operational differences is being recommended for both the benefit of the applicant as well as the City.

 

From a City or neighborhood perspective the operational changes based on Coparts business model provide several advantages including:

 

                     No crushing of vehicles (less noise)

                     No dismantling or parts picking (less noise and people on site)

                     Fewer daily customer visits (less traffic and noise)

                     Fewer vehicles/trucks going thru the gates on a daily or monthly basis (less traffic, dust or noise)

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, an application has been filed by Copart of Connecticut, Inc. as Conditional Use Permit Case File No.17-0063; and

 

                                          WHEREAS, the Blaine City Council has reviewed said case on January 18, 2018.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit Amendment is hereby approved per Section 31.14 (k) and Section 31.12 (l) of the Zoning Ordinance to allow for the transfer of rights and obligations under the CUP from John’s Auto Parts to Copart of Connecticut as part of the sale of the property based on the following conditions:

 

1.                     Outside storage of vehicles to be placed solely behind the fenced yard and not in public view.

2.                     Inventory storage to consist of used, undamaged and damaged passenger vehicles, trailers, watercraft, power sports and light duty industrial and construction equipment. No asset (piece of equipment or vehicle) shall exceed 12-feet in height or exceed six (6) tons.

3.                     Crushing of vehicles in not permitted.

4.                     Stacking of vehicles is not permitted.

5.                     Hours of operation shall be limited to 8:00-5:00 PM Monday thru Saturday.

6.                     Any changes to site lighting or building exterior shall require City review.

7.                     Any changes to site or building footprints shall require a CUP amendment and Site Plan Approval

8.                     All business signage by separate permit.

9.                     Site to operate consistent with Copart Statement of Operations dated December 21, 2017.

10.                     Lincoln Street shall not be used as an access to the rear of the site.

11.                     The applicant to utilize aggressive dust control program for the vehicle storage yard and travel paths.

12.                      The applicant to complete annual inspection of the perimeter wall and landscaping and replace any damaged or missing boards or landscape plantings.

13.                      Yard and building lights, equipment alarms, loudspeakers, etc. shall be managed in a manner so as to minimize disruption to adjacent residential areas.

14.                     The applicant should recognize that future roadway modifications to and along Highway 65 and the intersections of 109th, 107th, 105th are likely in the coming years and that those changes will likely create site and access changes for properties along this corridor.

15.                      Accumulated snow in the western portion of the yard to be piled in locations that allows for drainage to the east towards Highway 65 or removed from the site.

16.                     Copart to participate in Certificate of Occupancy (C.O.) walk-thru with the City (Building and Fire) and receive C.O. prior to occupancy of the site

17.                     Conditional Use Permit Resolution No. 11-102 shall remain in effect and shall supersede this resolution should the sale and transfer of property at 10588 Central Avenue from John’s Auto Parts to Copart not be completed by January 31, 2019.

18.                     Onsite part picking and dismantling of vehicles is prohibited.
