The Planning Commission voted unanimously to approve the waiver of platting. There were no comments at the public hearing.
Background
The current lot is 1.24 acres in size and is located at the corner of 107th Avenue and Coral Sea Street in the Sanctuary 8th Addition. The parcel was originally platted as two separate lots in 2006 which were later combined to accommodate placement of a fence around portions of both parcels, which were owned by the same person. There is an existing home on the eastern parcel that will remain.
The original parcels were 0.42 acres and 0.82 acres, while the proposed lots will be 0.40 and .84 acres, due to the movement of the internal lot line four feet to the east. The plans submitted by the applicant depict relocation of the portion of the fence that crosses the proposed property line. Removal or relocation of the fence has been added as a recommended condition of approval.
Since both lots were included in the subdivision, the park dedication fees for both lots have already been paid, therefore no additional park dedication fees are required with this waiver.
Drainage and utilities easements were established on the original lots. Due to the relocation of the lot line, vacation of a portion of the existing easement and establishment of new drainage and utilities easements are required with the waiver of platting. The portion of the easement to be vacated and the new easement to be created are shown on the submitted site plan. The area between the easement to be created and the easement to be vacated is currently in a drainage and utility easement, and shall remain in easement.
Recommendation
By motion, approve the resolution.

WHEREAS, an application has been filed by Troy Halverson as Waiver of Platting Case No. 19-0010 and;
WHEREAS, said case involves the division of a parcel into two separate lots, Anoka County, Minnesota, described as follows:

LOTS 7 AND 8, ALL IN BLOCK 2, THE SANCTUARY EIGHTH ADDITION, ANOKA COUNTY, MINNESOTA.
PARCEL A
LOT 8, BLOCK 2, THE SANCTUARY EIGHTH ADDITION, ANOKA COUNTY MINNESOTA, LYING WESTERLY OF THE EAST 4.00 FEET THEREOF.
PARCEL B
LOT 7 AND THE EAST 4.00 FEET OF LOT 8, ALL IN BLOCK 2, THE SANCTUARY EIGHTH ADDITIUON, ANOKA COUNTY, MINNESOTA.
WHEREAS, the Blaine Planning Commission has reviewed said case on April 9, 2019; and
WHEREAS, the Blaine Planning Commission has recommended said case be approved; and
WHEREAS, the City Council of the City of Blaine has reviewed said case on May 6, 2019.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Waiver of Platting per chapter 74 of the Subdivision Ordinance is hereby granted to Troy Halverson, allowing to record the above described division with the Anoka County Recorder’s Office, based on the following conditions:
1. Establishment of a five foot wide drainage and utility easement on both sides of the new internal lot line and vacation of excess easement, as depicted in the proposed site plan prior to the city’s signature on the waiver of platting documents for recording at Anoka County.
2. Removal or relocation of any fence on “Parcel A” is required prior to the city’s signature on the waiver of platting documents for recording at Anoka County.
3. The Mayor, City Clerk and City Manager are hereby authorized to execute any and all necessary documents, agreements and releases related to the approval, recording or administration of the waiver of platting.
