Background
The Fogerty Curling expansion received a Conditional Use Permit (CUP) in April of 2012. At that time they were uncertain of the size and seating arrangement for the outdoor dining that has been constructed as part of the restaurant. As the plans developed they determined the seating size for the patio and had Met Council Environmental Services include that SAC determination as part of the overall expansion permit.
 
The dining patio will consist of seating for 68 contained within a fenced area.
 
Recommendation
By motion, approve the Resolution.

Body
      WHEREAS, an application has been filed by Fogerty Curling Arena as Conditional Use Permit Case File No. 13-0025; and
 
      WHEREAS, the Blaine City Council has reviewed said case on April 18, 2013.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 31.30 of the zoning ordinance to allow for outdoor dining with seating for 68 people based on the following conditions:
 
1.      No outdoor advertising on the building wall, table umbrellas, fence or patio area without meeting all signage requirements including permits.
2.      The outdoor dining area will be limited to the above described area and limited to not more than 68 seats.
3.      The ability to operate outdoor dining is reliant upon the applicant's ability to adequately control litter and refuse associated with the facility.
4.      Serving of alcohol in the patio area to meet all City and State liquor requirements.
5.      Amplified outdoor music to be set at volumes at or below normal conversation level.
