ACCEPT BID FROM EBERT CONSTRUCTION IN THE AMOUNT OF $3,440,569.56 FOR THE LEXINGTON ATHLETIC COMPLEX, IMPROVEMENT PROJECT NO. 12-14
 
Background
Bids were received at 10:00 a.m., April 18, 2014, for Project No. 12-14.  A total of nine (9) bids were received with the base bid ranging from $3,439,549.56 to $5,844,955.45.  There were four (4) alternate bid items which increased the base bid totals by $24,240.42 to $77,203.00, however, the alternate bid items did not change the order of bidders.  The three lowest bidders and their base bids are as follows:

Bids have been checked and tabulated, and it has been determined that Ebert Construction of Corcoran, Minnesota is the lowest bidder.  Staff recommends that two (2) of the four (4) alternate bid items be added to Ebert Construction's base bid, bringing the contract amount to $3,440,569.56.  The Parks and Recreation Department has worked with Ebert Construction on previous contracts.  I recommend the low bid be accepted and a contract entered into with Ebert Construction in the amount of $3,440,569.56.  City Council is also asked to approve a 5% contingency to bring the total project budget to $3,612,598.00.
 
In addition for Council's information, there are other costs associated with this project that fall under the City Manager's purchasing authority as follows:  (1) Anoka County Food Service permitting fees for the concession stand, approximately $500; (2) Installation of the wireless canopy system by Whitewater Wireless for $2,700; and (3) SAC fee of $20,000.
 
Attached is spreadsheet that identifies all the costs associated with the construction of the Lexington Athletic Park. The following Council items will approve of these other costs.  The purpose of this spreadsheet is to show that there are enough funds budgeted in the Park Dedication Fund for all the costs associated with this project plus it will cover the Aquatore Field project shortfall, which is on this agenda as well.
 
 
Recommendation
By motion, approve the resolution.
 
Body
WHEREAS, pursuant to advertisement for bids for Improvement Project No. 12-14, said bids were received on April 18, 2014, opened and tabulated according to law, and the following three lowest bids were received complying with the advertisement:
 
Ebert Construction
$3,439,549.56
North Pine Aggregate, Inc.
$3,670,803.75
Forest Lake Contracting, Inc.
$3,809,695.00
 
AND WHEREAS, Ebert Construction of Corcoran, Minnesota is the lowest responsible bidder; and
 
WHEREAS, two alternate bid items will be added to the contract for an additional $1,020.00.
 
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Blaine as follows:
 
1.      The Mayor and City Manager are hereby authorized and directed to enter into a contract with Ebert Construction for the designated improvements in the amount of $3,440,569.56.
 
2.      A 5% contingency is hereby approved to bring the total project budget to $3,612,598.00, and the Public Services Manager is hereby authorized to sign all change orders up to the authorized project budget amount.
 
3.      The City Clerk is hereby authorized and directed to return forthwith to all bidders the bid bonds submitted with their bids, except the three lowest bidders.  When a contract is duly executed, the bid bonds of the two remaining unsuccessful bidders will be returned.  The bid bond of the successful bidder will be retained until the performance and payment bonds have been executed and approved, after which the bid bond will be returned.
