Background
T.E.C. Repair is proposing to construct a building addition located at 8950 Eldorado Street NE, which is zoned I-2 (Heavy Industrial).  This property currently has a conditional use permit for truck repair and outdoor storage, but requires a conditional use permit amendment to accommodate the business expansion.
 
The building addition being proposed is 4,659 square feet, which will make the entire building 21,163 square feet in size at completion.  The building has access off of Eldorado Street NE and Baltimore Street NE.  A total of 47 parking stalls are required for this site after doing a parking calculation for an industrial use.  There are 30 stalls currently provided on site with 2 additional proposed with the expansion.  Given that there is ample room on site to provide the required number of stalls, staff believes parking is adequate.
 
Upon inspection, staff noted that there were several business trucks for sale located in the front of the building.  These will have to be moved to the rear of the building behind the fencing in order for them to remain on site.
 
Staff also noted that there was a discrepancy in what was approved in the previous conditional use permit application in the year 2000 and what was inspected recently.  The driveway located on the southern portion of the property encroaches into the Baltimore Street right of way.  This driveway edge will need to be pushed back within the property lines before any financial guarantee is released.  
 
The building being proposed must meet the I-2 (Heavy Industrial) standards with regard to materials used.  Exterior wall surfaces of all buildings shall be primarily faced with brick, stone, pre-cast panel, cast-in-place panel, architectural concrete in combination with glass or other permitted materials.  The building addition will be built with pre-cast concrete panels, which matches the existing structure.

All lighting on site must meet current requirements.  If existing fixtures are not code compliant (downlit/screened) they will need to be replaced.
 
Recommendation
By motion, approve the Resolution.

      WHEREAS, an application has been filed by TEC Properties as conditional use permit amendment Case File No. 13-0045; and
 
      WHEREAS, the Blaine City Council has reviewed said case on August 1, 2013.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a conditional use permit amendment is hereby approved per Section 31.14 (m) of the zoning ordinance to allow for a 4,659 square foot truck repair expansion at 8950 Eldorado Street NE based on the following conditions:
  1. All conditions of Resolution 00-287 remain in force.
  2. All required site improvements be covered by a site improvement performance agreement and financial guarantee.
  3. All outside storage and truck parking to be part of the repair operation.  No long term storage of junk, truck parts, or outside miscellaneous materials.
  4. All business vehicles/trucks for sale must be located behind the fenced-in area in the rear of the building.  No business vehicles/trucks for sale are allowed to park in the front of the building.
  5. All lighting on site must meet current requirements.  If existing fixtures are not code compliant they will need to be replaced.
  6. The southern driveway that encroaches within the Baltimore Street right of way must be pushed back within the property lines before any financial guarantee is released.
