Executive Summary

At the November 1, 2021 council meeting the City Council awarded the bid for the Aurelia Park Pond Construction project to Jacon LLC with Resolution 21-208.  The project consists of the excavation of a new storm water pond located in Aurelia Park, including site grading, pipe and structure installation, tree removal and replacement and restoration.

Background

During the excavation of the pond, the contractor found that much of the soil that needed to be removed was actually contaminated fill. Soil borings had been done on the site that indicated fill, but when excavation began it was determined that the fill was construction debris, including concrete rubble, chunks of asphalt, timber and brick.

This debris needed to be hauled to a landfill for disposal. Staff received a quote from the general contractor Jacon and from a second trucking company. Jacon provided the lower estimate at $22.60 per ton of contaminated fill removal, compared to $45 per ton by North Pine Aggregate.

In total, 6,235.36 tons (3,767CY) of contaminated fill were removed from Aurelia Park.  Typically soil removal on an excavation project is quantified and paid by measuring the total amount of cubic yards of soil removed. Based on the existing conditions at Aurelia Park and the design of the new pond, 6,294 cubic yards of material were proposed to be excavated. Following the removal of the 6,235.36 tons (3,767CY) of contaminated fill, the pond area was re-measured to determine the final cubic yardage of remaining soil to be excavated.

Change Order 1 requests approval to issue payment to Jacon for the removal, hauling, and disposal of contaminated material from Aurelia Park. In total, this cost is $140,919.34. Change Order 2 reduces the contract amount by $51,984.60 in the contract line item for the original soil removal. The net total project increase to the contract is $88,934.54.

Strategic Plan Relationship

This project aligns with the City’s strategic plan goal for Growth Management and providing a Well-Maintained Infrastructure.

Board/Commission Review

Not required.

Financial Impact

The funding source for these improvements will be the Storm Water Utility Fund. The Finance Department has confirmed that sufficient funds are on hand to fund this change order.

The Total project budget of the contract including Change Order 1 and Change Order 2 is $386,583.34. The city originally budgeted $350,000 to construct this project. A partnership with the Coon Creek Watershed District allowed the city to receive a grant to partially fund the project. The grant will fund up to $77,542 of the construction for the project. With the grant funding, this project remains within the budget originally approved by Council.

Staff Recommendation

By motion, approve Change Order No. 1 in the amount of $140,919.14, Change Order No. 2 that reduces the common excavation contracted amount, and approves the new contract cost of $386,583.34, and authorize the Director of Public Works to sign said Change Order No. 1 and 2.
