Background

The Public Hearing was conducted on October 1, 2015 and there were no comments from the public. The vacation of drainage and utility easements for Larson Estates is being requested to allow for building expansion on the property (Stone Mountain Pet Lodge on Radisson Road).  A new wetland delineation line has been approved by the Rice Creek Watershed District allowing for the vacation.  The Engineering Department has reviewed this request and concurs with the vacation.

 

Ordinance No. 15-2325 was introduced for first reading at the October 1, 2015 Council meeting and is presented at this time for adoption.

 

Recommendation

By motion, approve the Ordinance.

THE CITY OF BLAINE DOES ORDAIN:  Chapter 216 is adopted as an Ordinance of the City of Blaine to read: (Added portions are underscored and deleted portions are shown in brackets with overstrike.)

 

Chapter 216  -  Vacation of drainage and utility easements

216.01                     -  That part of the Drainage and Utility Easement as dedicated on Lot 2, Block 1, LARSON'S ESTATES, Anoka County, Minnesota described as follows:

 

Commencing at the southwest corner of said Lot 2; thence South 89 degrees 10 minutes 25 seconds East (assumed bearing) along the south line of said Lot 2 a distance of 60.20 feet; thence North 5 degrees 28 minutes 53 seconds East a distance of 24.42 feet; thence North 43 degrees 15 minutes 33 seconds East a distance of 87.28 feet to the point of beginning of the easement vacation to be described; thence continuing North 43 degrees 15 minutes 33 seconds East a distance of 30.85 feet; thence North 57 degrees 33 minutes 30 seconds East a distance of 164.03 feet; thence North 31 degrees 49 minutes 53 seconds East a distance of 29.72 feet; thence North 69 degrees 54 minutes 17 seconds East a distance of 33.72 feet; thence North 88 degrees 24 minutes 56 seconds East a distance of 65.46 feet; thence South 60 degrees 36 minutes 58 seconds West a distance of 113.21 feet; thence South 51 degrees 55 minutes 36 seconds West a distance of 70.94 feet; thence South 61 degrees 39 minutes 08 seconds West a distance of 77.11 feet; thence South 30 degrees 49 minutes 34 seconds West a distance of 15.37 feet; thence North 90 degrees 00 minutes 00 seconds West a distance of 42.12 feet to the point of beginning.
