VACATION OF DRAINAGE AND UTILITY EASEMENT, LOTS 2 & 3, BLOCK 1, UNIVERSITY PARK ADDITION, VACATION NO. V15-06
Background
Public and written notice has been provided as required by City Charter. A petition dated December 4, 2015, was submitted to the City by Scott Adams of Buffalo, Minnesota, requesting vacation of drainage and utility easements on Lots 2 & 3, Block 1, University Park Addition. This vacation is being requested in order to facilitate the construction of a new commercial building. The applicant is a single property owner who represents 100% of the affected property abutting this easement. The Engineering Department has reviewed this request and concurs with the vacation.

This easement vacation is being processed under the newly adopted Charter amendment to allow easements to be vacated by resolution rather than ordinance. Please note the public hearing process has not changed, just the adoption process.
Recommendation
By motion, approve the Resolution.
Body
WHEREAS, the City Council has received a petition dated the 4th day of December, 2015, requesting vacation of easements for drainage and utility purposes granted in the plat of University Park Addition; and
WHEREAS, the required public hearing notices were published and mailed, and the public hearing was held on the 18th day of February, 2016, at which time all persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:
1. The vacation of drainage and utility easement on Lots 2 & 3, Block 1, University Park Addition is hereby approved as described:
That part of the Drainage and Utility easement as shown on University Park Addition, according to the recorded plat thereof in Anoka County, Minnesota, that lies in the northerly 5 feet of Lot 3, Block 1, said University Park Addition, except the westerly and easterly 10 feet thereof.
And
That part of the Drainage and Utility easement as shown on University Park Addition, according to the recorded plat thereof in Anoka County, Minnesota, that lies in the southerly 5 feet of Lot 2, Block 1, University Park Addition, except the westerly 10 feet and the easterly 68 feet thereof.
PASSED by the City Council of the City of Blaine this 18th day of February, 2016.
