Assign Construction Contracts to RJM Construction for the Blaine City Hall and Police Department Improvements
Executive Summary
The City has appointed RJM Construction to be a Construction Manager at Risk (CMAR) for the City Hall/Police Department expansion project. By appointing RJM as a CMAR, RJM is committed to deliver the project within a Guaranteed Maximum Price (GMP) which is set when bids are assigned. As such, the City is assigning the construction contracts, awarded through an open bid process, to RJM.
Background
On March 21, 2019, RJM was hired as the construction manager for the Blaine City Hall and Police Department improvements and third floor expansion.
RJM has been engaged on the project since the design phase began in 2019 and has worked closely with staff and Wold Architects to provide construction guidance and cost estimates.
Included in the GMP is a construction contingency to cover the risk for overruns or scope gaps.
Under the CMAR method, the Council will receive and award bids, then reassign the contracts to RJM. This process will result in substantial savings of staff time needed to manage the project, including the time needed to process change orders.
The project was advertised for bids to be submitted beginning February 2 until 2:00 PM on March 2. There were nine different bid categories and 14 quote categories. The bids and quotes were reviewed by RJM and Wold.
The attached resolution assigns the awarded bids, quotes, and any approved alternates to RJM.

WHEREAS, the City of Blaine (“the City”) and the Contractor (“RJM”) entered into a Standard Form of Agreement between Owner and Construction Manager ("Contract") on June 9, 2020, whereby RJM undertakes the construction management of project known as the Blaine City Hall and Police Department Improvements ("Project"); and
WHEREAS, the project was advertised from February 2 to March 2, 2021, and bids were publicly opened on March 2, 2021; and
WHEREAS, the Project bid documents included the proposed contract for the Work (as defined in the Contract); and
WHEREAS, the Contract requires that the City assign to RJM all of City's rights in and to contracts for the construction of the Work (as defined in the Contract) which were competitively bid and awarded by the City.
NOW, THEREFORE, in consideration of the mutual promise and agreements made in the Contract and other good and valuable consideration the receipt and sufficiency of which is hereby acknowledged:
1. City hereby grants, transfers and assigns to RJM all of its rights, title and interest in and to the contracts identified below as included in the bid documents.
2. RJM hereby consents to and accepts this Assignment and agrees to perform all of its obligations under the Contract for the benefit of the City. RJM will enter into contracts with those contractors awarded the bids, quotes, and alternates by the City in the same form included in the bid Documents.
3. This Assignment shall be binding upon and inure to the benefit of the City and RJM and their respective heirs, successors and assigns, as the case may be.
4. This Assignment may be signed in more than one counterpart, together which shall constitute an original document.
WHEREAS, there are three alternates for the project as determined by the project team (Wold, RJM and staff).
1. $47,484 for additional Building Inspection offices
2. $40,795 for storage cubbies for police officer duty bags
3. $36,229 for expanded high density storage in the police evidence room.
NOW, THEREFORE BE IT RESOLVED, that the Blaine City Council’s assign the construction contracts for bids, quotes and three alternates to RJM Construction for the City Hall and Police Department Improvements in the amount of $3,453,360.
