APPROVE JOINT POWERS AGREEMENT WITH THE CITY OF CIRCLE PINES FOR THE PARTIAL RECONSTRUCTION OF 87^TH AVENUE, BLAINE IMPROVEMENT PROJECT NO. 15-11

Background

The attached Joint Powers Agreement (JPA) has been prepared with the City of Circle Pines for the partial reconstruction of 87^th Avenue in the City of Circle Pines.  The JPA states that the City of Circle Pines will reconstruct 87^th Avenue from the west city limits of Circle Pines to Canterbury Road as described in the plans and specifications for Circle Pines 2015 Street Improvement Project.  Circle Pines will provide all engineering services, bid the project in accordance with Minnesota Law and pay all construction costs.  The City of Blaine agrees to specially assess three parcels in Blaine that access 87^th Avenue and receive benefit from the project.  Blaine will make payments to the City of Circle Pines on an annual basis after assessments are received from the three Blaine parcels.    

Recommendation

By motion, adopt the Resolution.

Body

      WHEREAS, the City of Circle Pines and the City of Blaine desire to jointly cause the improvements of spot concrete curb and gutter replacement, removal of the existing pavement, subgrade correction as needed and installation of 3.5 inches of new bituminous pavement for the benefit of the traveling public; and

      WHEREAS, Minnesota Statutes Section 471.59 authorizes the City of Circle Pines to enter into an Agreement with the City of Blaine to provide for the joint exercise of powers common to each; and

      WHEREAS, said Agreement details the responsibilities of the City of Circle Pines as to the costs associated with the design, construction and future maintenance of 87^th Avenue.

      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine as follows:

1.      Joint Powers Agreement between the City of Circle Pines and the City of Blaine with regards to the partial reconstruction of 87^th Avenue is hereby approved.

2.      The Mayor and City Manager are hereby authorized and directed to execute said Agreement.
