Background
Public and written notice has been provided as required by City Charter.  The applicant is a single property owner who represents 100% of the affected property abutting this easement. The vacation of street right-of-way is for Trunk Highway 65 West Frontage Road adjacent to the east property line of Lot 1, Block 1, Sandler Place. The vacation is being requested for the Park Dental office to expand their parking.  The Engineering Department, Center Point Energy and Xcel Energy have reviewed this request and concur with the vacation.  A drainage and utility easement will be granted over the vacated area to cover existing utilities.  No objections were heard at the Public Hearing.
 
Ordinance No. 12-2251 was introduced for first reading at the June 21, 2012 meeting and is presented at this time for adoption.

THE CITY OF BLAINE DOES ORDAIN:  Chapter 196 is adopted as an Ordinance of the City of Blaine to read: (Added portions are underscored and deleted portions are shown in brackets with overstrike.)
 
Chapter 196 -  Vacation of Street Right-of-Way
196.01 -  That part of the South Half of the Southeast Quarter of the Northwest Quarter of Section 5, Township 31 North, Range 23 West, said Anoka County, which lies westerly of the following described "Line A", which lies easterly of the east line of Lot 1, Block 1, SANDLER PLACE, according to the recorded plat thereof, Anoka County, Minnesota, which lies northerly of the easterly extension of the south line of said Lot 1 and which lies southerly of the line described as follows:
 
Commencing at the northeast corner of said Lot 1; thence westerly, along the northerly line of said Lot 1, a distance of 215.03 feet to the westerly point of curve in the north line of said Lot 1; thence easterly, along the northerly line of said Lot 1, a distance of 152.20 feet to the easterly point of curve in the north line of said Lot 1 and the point of beginning of the line to be described; thence northeasterly along a tangential curve, concave to the north, having a radius of 120.00 feet, to the intersection with the following described "Line A" and said line there terminating.
 
"Line A" is described as commencing at the north quarter corner of said Section 5; thence run westerly on an azimuth of 269 degrees 22 minutes 56 seconds (azimuth oriented to Minnesota State Plane Coordinate System, South Zone) along the north line of said Section 5 for 50.86 feet to Right of Way Boundary Corner M907A as shown on Minnesota Department of Transportation Monumentation Plat 02-M19 as the same is on file and of record in the office of the County Recorder in and for said County, which is the point of beginning of "Line A" to be described; thence southerly 100.98 feet on a non-tangential curve concave to the west, having a radius of 5829.34 feet, a delta angle of 0 degrees 59 minutes 33 seconds and a chord azimuth of 179 degrees 51 minutes 27 seconds; thence on an azimuth of 180 degrees 21 minutes 11 seconds for 2507.66 feet and there terminating.
 
196.02  - Said vacation has been made after Notice of Public Hearing in conformance with Minnesota Statutes and pursuant to Chapter 12, Section 12.06, of the City Charter of the City of Blaine.
