Background
In 2001, the City approved a conditional use permit that allowed the construction of a solid waste transfer station at 3280 99th Court, known as Shamrock Disposal.  A conditional use permit amendment was approved in 2006 that allowed wood recycling and yard waste storage to take place outdoors and it allowed the construction of a second building on site.  Since that time, the owner of the property has changed and the new owner would like to modify the operations of the facility to end the construction and demolition debris recycling that took place on this site, and to create additional capacity to transfer municipal solid waste, yard waste and single stream recycling.  
 
Since this is a minor amendment, the Planning Commission did not review this request.  The only physical change to the site is the addition of an outbound scale near the southeast corner of the building to improve traffic flow. There are minor changes to the interior of the existing building being proposed.  This request is simply to change the type of debris being handled on site from construction and demolition debris to municipal solid waste, yard waste and single stream recycling.  The applicant would also like to  increase the amount of yard waste storage to 800 cubic yards in the outdoor storage area (50-foot by 50-foot bunker).  The applicant has gone through the appropriate EAW process with the MPCA to make this change and is now asking the City to approve the change as well.  
 
Since there are some minor changes being proposed inside the building, a condition has been added that requires a building permit for all interior remodeling on site.  Other than that, the conditions of approval in Resolution 06-200 remain essentially unchanged, with the exception that some conditions have been removed that no longer apply to the site.  
 
The new resolution will allow the applicant to store up to 800 cubic yards of yard waste in the outdoor storage area and this will be stored in the appropriately noted area on the site plan.  It is the applicant's intent to remove the yard waste daily, but would like the ability to keep the yard waste on site for up to three days, in case there is a long holiday weekend to contend with.  
 
Recommendation
By motion, approve the Resolution.

PER SECTION 31.14(e) OF THE ZONING ORDINANCE
 
      WHEREAS, an application has been filed by Shamrock Recycling and Transfer as Conditional Use Permit Amendment Case File No. 12-0024; and
 
      WHEREAS, the Blaine City Council has reviewed said case on November 1, 2012.
 
      NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit Amendment is hereby approved per Section 31.14 e of the zoning ordinance to allow for transfer of municipal solid waste, yard waste and single stream recycling at 3280 99th Court NE based on the following conditions:
 
1.      All conditions of Resolution 01-141 remain in effect, with the exception of conditions 3 and 10.  
 
2.      This resolution replaces Resolution 06-200.  
 
3.      Construction must be consistent with all materials submitted for this conditional use permit amendment.  
 
4.      All parking stalls shown on the site plan must be striped.
 
5.      All passenger vehicles to be parked on a hard surface at all times.  In other words, no vehicle parking is allowed on the gravel surface shown on the site plan.  
 
6.      The roll-off dumpsters on site must be stored in the area shown on the attached site plan.  This area can be surfaced with gravel.  These dumpsters cannot be stored in any other location on site.  
 
7.      Yard waste material storage will be limited to no more than 800 cubic yards.  The material must be stored as shown on the attached site plan, and the material must generally be hauled off site on a daily basis to avoid odors emitting from the area on a regular basis.  The exception to this rule are long holiday weekends where 3 days are needed to remove the yard waste.  Cleaning of the storage bin is required as needed to eliminate odors.
 
8.      The building around the wood grinder that has at least two sides and a roof must remain in place if a wood grinder is to be used on site.
 
9.      The 15-foot fence that has been installed on the west side of the site must remain.
 
10.      The following landscaping has been planted and is required on the entire site to meet ordinance requirements:
 
Overstory Trees:

Shrubs:
105 (3-feet in height)
 
11.      All lighting on site must meet the requirements of the Zoning Ordinance, be downlit and shielded, and pole mounted lighting is limited to 20-feet in height.
 
12.      Building permits must be obtained for any work being done inside the existing buildings on site.
