Background
The public hearing was held at the City Council meeting on Thursday, May 2, 2013.  The vote to order the improvements was postponed until the May 16, 2013 City Council because the required super majority (four-fifths) of all council members was not present to order the improvements as required by Minnesota Statutes, Chapter 429 for a project initiated by Council.  
 
The proposed project is the second phase of a multi-year project to partially reconstruct the streets and improve storm water runoff drainage in the industrial park area generally defined by 94th Lane on the north, Baltimore Street on the west, Radisson Road on the south and 93rd Lane Extension on the east.  Proposed improvements for Phase 2 include asphalt pavement replacement, gravel shouldering, storm drainage improvements, culvert replacements and cleaning, traffic control signage, and appurtenant construction for Baltimore Street from approximately 410 feet north of 93rd Lane to 91st Avenue, 92nd Lane from Baltimore Street to Davenport Street, 92nd Avenue from Baltimore Street to the cul-de-sac and 91st Avenue from Baltimore Street to Isanti Street.  The estimated cost is $976,860 with $402,658 proposed to be assessed amongst benefitting properties over a ten-year period.  The remaining portion of $574,202 is proposed to be paid from the City's Pavement Management Program funds.  The project is necessary, cost-effective and feasible and will result in a benefit for the properties proposed to be assessed.

Recommendation
Approve the resolution.
 
Body
WHEREAS, Resolution No. 13-051 of the Blaine City Council, adopted on the 4th day of April, 2013, ordered a public hearing on the proposed project; and
 
WHEREAS, the required notices were published and mailed to benefiting property owners, and the public hearing was held on the 2nd day of May, 2013, at which time all persons desiring to be heard were given an opportunity to be heard.
 
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Blaine as follows:
 
1.      Such improvements are hereby ordered as proposed in the Feasibility Report, which was accepted by Resolution No. 13-051 adopted on the 4th day of April, 2013.
 
2.      The City Engineer is hereby designated as the Engineer for this improvement and is directed to prepare plans and specifications for the making of this improvement.
 
3.      The contract shall be awarded no later than May 15, 2014.
