Planning Commission

The Planning Commission voted to approve the conditional use permit.  There were no comments at the public hearing.

 

Background

The applicant wishes to reconstruct the existing detached garage by raising the structure 6 feet in height. The detached garage structure will remain at 440 square feet. The applicant currently has an existing attached garage that totals 676 square feet. This provides a total of 1,116 square feet of garage area on the property. In the R-1 (Single Family) zoning district, a conditional use permit is required for garage areas larger than 1,000 and up to 1,200 square feet.

 

The applicant and his wife have lived at this residence since they built the house over 30 years ago. Because the structures have been there for so long, there is no record of a building permit on the existing detached garage making it a legal non-conforming use. The applicant would like to reconstruct the detached structure to allow for the storage of three vehicles and a boat, and determined that raising the structure in height would be the best option for his existing site. The city requires that a conditional use permit be obtained in order to bring the structure into conformance with current city ordinances. Again, the R-1 (Single Family) zoning district allows for over 1,000 square feet and up to 1,200 square feet of garage space by conditional use permit. 

 

The applicant has maintained both existing structures by pulling the proper permits as required. The applicant has already talked with our building department staff regarding the structure’s ability to withstand the proposed reconstruction, and will continue to do so throughout the permitting process.

 

The applicant has a wooded lot, and plans to remove three trees throughout the reconstruction process. Section 33.10 of the zoning ordinance allows property owners to remove two trees per lot, per year. Additional trees that are removed as a result of construction must be replaced. Therefore, the applicant will be required to replace one tree.

 

Recommendation

By motion, approve the Resolution.

Body

                     WHEREAS, an application has been filed by Glenn Thoeny as Conditional Use Permit Case File No. 17-0032; and

 

                     WHEREAS, a public hearing has been held by the Blaine Planning Commission on August 8, 2017; and

 

                     WHEREAS, the Blaine Planning Commission recommends said Conditional Use Permit be approved; and

 

                     WHEREAS, the Blaine City Council has reviewed said case on September 7, 2017.

 

                     NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Blaine that a Conditional Use Permit is hereby approved per Section 29.34(i) of the Zoning Ordinance to allow for 1,116 square feet of garage area, and to allow for the reconstruction of the existing 440 square foot detached structure at 4152 Flowerfield Road based on the following conditions:

 

1.                     The applicant must obtain a building permit prior to the start of any reconstruction.

2.                     The proposed reconstruction must include colors, and materials, that match the existing structures.

3.                     The proposed garage must be used for personal storage only, and may not be used for a home occupation.

4.                     The proposed garage must meet all the setbacks and requirements as outlined in section 29.30 of the Zoning Ordinance.

5.                     The garage door will be limited to 10 feet in height.

6.                     The newly reconstructed garage must not be taller than the existing structure.

7.                     The applicant will be required to plant one tree on the property, or pay $300 to the cities reforestation fund.
