APPROVAL OF CONDITIONAL EXTENSION OF
AGREEMENT WITH THE NATIONAL SPORTS CENTER
FOR OPERATION OF A BORROW PIT
 
Background
In 2003, the former City Manager signed an agreement with the National Sports Center (NSC) that acknowledged the Sports Center was going to operate a borrow pit for up to eight years.  The agreement established hours of operation, haul roads, and security of the site. The agreement was in lieu of our standard land reclamation process since it was with a state agency.  In 2009, the agreement was extended for an additional two years.  In 2011, the agreement was again extended for an additional two years through April 21, 2014.  
 
On April 7, 2014, a letter was received from the NSC requesting an additional extension to Resolution No.11-66 passed by City Council on June 16, 2011.  The letter states that the project is 80% complete and that the NSC is seeking an extension through October 31, 2014 under the same terms and conditions set forth by the existing resolution.
 
One additional condition is recommended for the NSC to comply with National Pollutant Discharge Elimination System (NPDES) regulations:   The NSC shall be required to monitor and inspect daily the condition of 105th Avenue relative to the tracking of dirt and gravel onto 105th Avenue as a result of activity to and from the borrow pit.  The street must be swept from curb to curb removing sediment and gravel from the street and gutters.  The area to be maintained shall be from the intersection of 105th Avenue and Radisson Road to the entrance to the borrow pit and as far south on Radisson Road as evidence of tracking is found.  Sweeping must take place before weekends and/or events at the National Sports Center.
 
 
Recommendation
By motion, approve the resolution.
 
Body
WHEREAS, the City of Blaine has an agreement and amendments with the National Sports Center to operate a borrow pit through April 21, 2014; and
 
WHEREAS, the National Sports Center has requested an extension of their permit from April 21, 2014 through October 31, 2014; and
 
WHEREAS, the National Sports Center shall be required to monitor and inspect daily the condition of 105th Avenue relative to the tracking of dirt and gravel onto 105th Avenue as a result of activity to and from the borrow pit.  The street must be swept from curb to curb removing sediment and gravel from the street and gutters.  The area to be maintained shall be from the intersection of 105th Avenue and Radisson Road to the entrance to the borrow pit and as far south on Radisson Road as evidence of tracking is found.  Sweeping must take place before weekends and/or events at the National Sports Center.  
 
NOW, THEREFORE, BE IT RESOLVED that the Blaine City Council does hereby approve the Conditional Extension of the April 21, 2003 Agreement with the National Sports Center for Operation of a Borrow Pit with the above mentioned conditions through October 31, 2014.
