Background
The Public Hearing was opened and conducted at the August 2, 2012 City Council meeting. There were no comments or objections made at the public hearing.
 
The current owners purchased the veterinary outpatient clinic at 625 County Road 10 NE in 2007 under the name of Companion Veterinary Hospital. They were not aware of the Conditional Use Permit requirements prior to purchasing the building from the former owner. However, after learning of the CUP requirements they have spent the last several years trying to establish the business in order to comply. These improvements (site work and fire suppression) were required in the original Conditional Use Permit to be completed initially in 2007.
 
In November of 2011 the City Council extended the time period for two years on the required parking lot and landscape improvements. The Council also extended the timeframe for the required fire suppression but only for one year. At the same time however the City Council requested that the applicant provide, within 6-months, a specific plan and timetable for completing the building fire suppression system.
 
The City Council discussed this issue with the applicant (Sharyl Gandara) at the May 17th City Council workshop. The total project cost to add the fire suppression system, based on bids obtained by the applicant, is $46,000. At that workshop several options were presented by staff with the council consensus being to move forward with providing City/EDA assistance in the following manner:
 
· $23,000 special assessment (plus $230 assessing fee) paid back by the property owner over a 10 year period at 5% interest
· $23,000 matching grant (Fire Suppression Grant)
 
The funds will be drawn from the EDA Fire Suppression Fund that was established a number of years ago. The applicant has signed an assessment agreement and has recently completed the work.
 
Recommendation
By motion, approve the Resolution.

WHEREAS,; pursuant to proper notice duly given or waived as required by law, the City Council has met and heard and passed on all objections to the proposed assessment for the installation of a required automatic fire suppression system for the building at:
 
625 County Road 10 NE., PIN # 31-31-23-43-0045
 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Blaine as follows:
 
1.      The proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the improvement in the amount of the assessment levied against it.
2.      The owner of any property so assessed may within thirty (30) days of the adoption of this resolution pay the whole of the assessment with no interest to the City's Special Assessment Clerk or make partial prepayment in the amount of at least ten percent (10%) of the total assessment to the City's Special Assessment Clerk with no interest.  Any remaining assessment will be payable according to this resolution.
3.      Assessments shall be payable in annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January, 2013.  Installments shall bear interest at the rate of five percent (5%) per annum from the date of the adoption of this assessment resolution.  To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2013.  To each subsequent installment when due shall be added interest for one (1) year on all unpaid installments.
4.      The owner of any property so assessed may at any time after December 1, 2012 pay to the City's Special Assessment Clerk the remaining principal after payment of the current installment prior to November 15 of any year with no further interest charged on the remaining principal.
5.      The City Manager shall forthwith transmit a certified duplicate copy of this assessment to the County Auditor to be extended on the proper tax lists of the County and such assessments shall be collected and paid in the same manner as other municipal taxes.
